Universal credit and disabled child element backdating

Hey all, my little one was awarded DLA on the 7th of December. MRC and LRM which was backdated to the 31st of July. I updated my journal same day requesting disabled child element to be added and backdating was told they will investigate this. Heard nothing else so sent message in January to be told the same thing. I sent another message on 9th of February to be told its been sent to decision maker and as soon as they have an answer will update journal. Anyone else still waiting for element to be added as well as backdating???

I updated uc 2 days ago sons details verified back pay sent to descion maker and my statement this month will show the new change.
So it's taking months for the back pay omg I waited 23 weeks for dla claim afyer having night mare with royal mail loosing the sen report so sent it sp delivery.
My anxiety was through the roof then now more waiting 🫣

Oh gosh that’s a nightmare !
I hope you hear back quickly from the decision maker. The whole set up is silly , shouldn’t need to go to a decision maker when it concerns child DLA

Spoke to soon....just recieved a letter telling me how much they owe!
The phone call yday must of gave them the kick up the bum they needed 🤣

How long after they told you what they owe was the money in your bank?x

Hi guys my son got awarded mrc and lrm in late December and updated UC which then had to go to the jobcentre to verify my children which I did but now just waiting for UC to reply to my message on journal which I know they really detest because if they didn't they would be getting back to us alot quicker! Anyway I was wondering as I'm new to all of this do they take the benefit cap off if your child is receiving DLA and if so do they backdate that benefit capped money aswell as child disabled element and carers element please and thank you???

Hello! I reported to UC that my
kid got DLA the same day I got answer from DLA. I asked UC for back pay and they responded:
We'll refer this to a decision maker for consideration.
Anyone knows how long this could take?

Mine didn't take that long but others have waited weeks/months for it to be sorted out. Make sure they have updated your claim correctly under the children’s section too

Hi wonder if anyone can help. I told uc about my sons higher rate dla claim in Dec 2021 and wasn't aware of the disability element. Would this be backdated?

@Amyw27 yes, you can request the severely disabled child (and the carers element if you haven’t got that either) are backdated. Depending on whose desk it lands on, they may try to refuse. If that happens, you can challenge the decision.

If you told them within one month of receiving the initial award notice in 21 and you updated the children’s section , surely that’s on the UC for not updating the claim correctly.

Not sure if they will backdate it right back to 2021 but it’s defiantly worth doing going forward to ensure you receive the disabled element and also carers x

My daughter just got awarded enhanced rates in both transferring from dla to pip how does it work with UC when she was on dla she got standard rate no mobility but now get enhanced on pip decision was made on the 30/5

@VickieC86 you should inform UC of the change. You will now be eligible for the severely disabled child element. You should already have the carer element and that won’t change.

Hi. I get carers allowance. Bc she was getting DLA will there be back pay on UC I know they won’t on pip as she’s been still getting DLA she’s got one last payment due from them on 17th

The carer element of UC is separate to carer’s allowance. The severely disabled child element will only be payable from the UC assessment period during which the PIP award starts. Depending on how quickly UC sort it out, there may be a month or two backdated, but it won’t be backdated before the start of the PIP award.

I think pip got the forms back before middle March as she turned 16 February

Because DD is transitioning from DLA to PIP, the PIP award doesn’t start from when you returned the form. It isn’t backdated.

They made decision 30th may so will it be from then

ive Just migrated to uc from CTC an income support she’s still in education an going to continue with it do you know how that would work as well now not on CTC

You will be eligible for the severely disabled child element from the date the PIP award begins rather than the date the decision was made.

Because you have transitioned to UC from CTC, if you are getting transitional protection, the severely disabled child element may eat into that.

Hi I did exactly the same I think with in the week after it got sent to the decision maker they approved the back pay but I’ve not had a letter to say how much and when yet. Hopefully this is helpful x

Hi ive just been reading through all these comments but cant seem to see the answer. I am currently waiting for my daughters DLA to be awarded but wondering with the UC bit do you ask to be backdated from when you applied for DLA or when you actually get your award letter?

If awarded DLA, the disabled child and carer element can be backdated to the start of the DLA award.

With a few limited exceptions, if you called for the form and returned it by the date given, that will be when you called for the form. If you didn’t call and used the form you can get from online, it will be when DLA received the form. If you called for the form but didn’t return it on time, it will either be when you called for the form or when they received it depending on why you didn’t return it on time, your circumstances and to an extent whose desk it lands on.
