Universal credit and disabled child element backdating

Hey all, my little one was awarded DLA on the 7th of December. MRC and LRM which was backdated to the 31st of July. I updated my journal same day requesting disabled child element to be added and backdating was told they will investigate this. Heard nothing else so sent message in January to be told the same thing. I sent another message on 9th of February to be told its been sent to decision maker and as soon as they have an answer will update journal. Anyone else still waiting for element to be added as well as backdating???

Do you mean the start date of the DLA award was last year but you have only just received the decision? Or do you mean you knew about the DLA award before now? Because that will affect what you right on the journal.

@SearchingForSolitude i was referring to what you said Contact CTC if you were on that at when the DLA award started. Because I now know that I cannot get UC disabled child and carer elements backdated to last year because my UC claim only started last month

Yes, but with respect to UC and your journal, what you write depends on if you have only just received notification DLA has just been awarded but the start date of the award was last year or if DLA was being paid before now.

For example, if DLA has just been awarded but the start date of the award was last year and that is why you didn’t declare DC receives DLA and that you are a carer when you applied for UC then you explain that and request the elements be backdated to the start of the UC claim (which happens to be last month anyway).

The elements will only be backdated to when you claimed UC.

No I've been getting dla for awhile now I was awarded last year and this year February I got my back payment and then I applied for careers allowance and i was on income support and child tax credit at the time and then I got a letter 3 months ago saying I have to change over from legacy benefits on to UC. Like I said I don't that much about UC so I just thought they would payback the disabled and carer element from last year but i wasn't on UC so I get it now

So you don’t need to do anything in relation to UC. You have received the UC elements. You were receiving CTC so your UC claim date won’t be backdated.

How would i find out if the earnings would wipe out the 2 elements? Is there a way to work it out?

@SearchingForSolitude ok Hun thank you. I totally understand I just didn't get her message in the pic I posted when she said if u like to request your entire UC claim backdated this is a separate issue and you will need to provide a reason as to why you want the claim backdated.

@GemzZ92 you add up all the individual elements on your claim. Deduct the work allowance (£404 if you have the housing element or £673 if you don’t have the housing element) from earnings (after tax, NI and pension contributions). Multiply the remaining amount by 0.55. Then deduct this amount from the total of all the elements. If you claim carer’s allowance that is also deducted £ for £. Following all the deductions if the answer is more than £0 you still receive some UC that AP. If it is £0 or less, you don’t.

I have a same issue with them and don’t even know what to do rang them and left messages but keep getting same answer I applied for the disabled and cares element to be backdated on trying to 27th of June it’s been 2 months for me and I’m still waiting

Thankyou. So if we are entitled to £0 that month does that mean we wont get the Carers element or Child disabilty element??

I find it so confusing! Id just like to know whats what but cant seem to work it it out! Ill just have to wait and see next month...i dont expect any UC because of how the paydays land.

I just got a letter on my journal saying all approved and back pay has been issued this morning, making it 9 weeks in total x

Hello, sorry to interrupt the thread...I've read alot and it clearly varies in relation to the timing, I'm just seeking some reassurance.

My son was awarded highest rate care and mobility, I received the letter 22 June, updated universal credit 23 June (we were away for one night). Both child disability elements were back dated to November 2023. I requested backdated pay (after some reading) on 23 June when I updated UC.

UC have now included enhanced mobility and carers element in July and August statements. Still heard nothing in relation to UC backdating this...is that normal? It's over 9 weeks wait so far. Although UC state it went to DM on 25 July, which I'm guessing is the date all details confirmed? Thanks for any input!

im on week 6 now and only response i get is that its with a decision maker.

They've not mentioned this though and I spoke to debt management friday and they've said an overpayments not even showing yet even though they've put on my journal I had an overpayment

I keep hearing about people’s claims being ‘with the decision maker’, but if your child gets DLA there is no decision to be made. Surely they should be awarded the disabled child element there and then.land back dated to when the DLA started….

2 days but that's because I rang and made complaints as they completely ignored me for 2 weeks. I've now had to make a complaint regarding the carers element it's rediclious, I'm on about 6 weeks now waiting for carers
