Universal credit and disabled child element backdating

Hey all, my little one was awarded DLA on the 7th of December. MRC and LRM which was backdated to the 31st of July. I updated my journal same day requesting disabled child element to be added and backdating was told they will investigate this. Heard nothing else so sent message in January to be told the same thing. I sent another message on 9th of February to be told its been sent to decision maker and as soon as they have an answer will update journal. Anyone else still waiting for element to be added as well as backdating???

I knew it takes a while, that doesnt bother me its just with them not answering so I'm not sure where in the process they are if that makes sense, or if it's even been sent to a decision maker or getting ready. They've not answered anything I've asked, it's frustrating because you don't know if you've done everything right 😂🤦🏻‍♀️

Hi were any of you told the dc element would not be backdated at first?

I updated on my journal in mid July when I heard my dd was getting her DLA, and said that DLA was being backdated from March and gave the date of the DLA award. The dc element is showing on my statement for this month, but nothing about back pay. So I wrote a message in the journal asking. The reply was really snarky saying 'if you wanted it from March you should have put that in your claim and claimed it in March' even though I did write that date and obvs I couldn't claim it in March because I didn't know until July! And the reply went on to say it won't be backdated as I didn't put the March date, even though I did. I've left another journal entry asking for it to be backdated and pointing out I already did write the March date. So frustrating how they make everything a battle.

The end of July I updated everything and asked for the elements to be backdated to feb when we were awarded from. They completely ignored me so I rang and someone said someone was supposed to get back to me by the 15th, they never did and so I rang again to be told someone would get back to me by tomorrow.

Someone's added to my journal telling me that they've added carers element and carers allowance and it's showing as an overpayment so collections will be in touch to set up a payment plan. My statements have all been changed to add carers element and that I should of had carers allowance deductions but nothing about the disabled child element or what they owe me.

I've written back and said that's all well and good and i will set up a repayment for carers allowence overpaymnet, but when will the disabled child element be added and my request for backpaymet for carers element and disabled child element be sorted?

They're rediclious as soon as you owe them theyre straight on you yet when they owe you it takes literally forever.

@SearchingForSolitude thank you, I'll see what the latest reply will be then I'll use that phrase. When I got my ds disabled child element added they did the backdating automatically so I don't know why it's been such a trial for my dd Hmm

I am waiting for backdated payment over a month, maybe it will be helpful if I write on journal that I need it for school clothing shoes etc🤔

I don't think they care. Literally nobody's answered me when I've requested backpaymet the 31st July, I've supposed to have a response by the 15th August, then today, now the 27th..
but they did put a note on yesterday saying theyve added my carers allowance and i owe them money now and collections will be in touch 😐🤦🏻‍♀️

Seems they can chase you very quickly if you owe them yet can't give you the decency to answer when they owe you.

I've had a case manager ask for various different reasons.

For me it's over a month and yesterday I write on my journal asking how long it can take. Answer was same when it's done will be in journal there's no time frame

Atleast you've been lucky enough to get an answer I've literally been ignored since end of July so had to be consistently calling 🤦🏻‍♀️🤦🏻‍♀️🤦🏻‍♀️

Im new to all this 🙃
My boy has beem awarded and ive asked for the elements backdated. 2 weeks ago...will.wait another 2 before popping another msge on my journal. Theyve told me its been sent to a DM regarding backpay. But when i recieved a £0 award will i still recieve the disabled child and carers element? Me and my partner both work but if he has 5 pay days in our assessment period we very rarely got any uc that month. Its so daft how it works. I dont know how to work it out.

Hi my UC assessment started last month and I requested for both my carers and disabled element to be backdated to August last year when I was awarded my dla and they said no back pay is this right.

Do you mean you've been phrased over to uc from other benefits last month? If so that's correct as they either backpay to when your dla was awarded if already on uc, or to when claim was opened. I've read it would be tax credits or whatever you've moved over from that would of been responsible for payments and backpay.

Hi Hun yes i was getting child tax credit and income support before but now in on UC. So is that correct I don't get back pay for the elements I just want to be sure because when I called in the woman said I could and my case manager said no back pay on my journal

As far as I'm aware from what I've read and seen they wouldn't backdate to last year as you wasnt eligible for the elements at that time as you were on tax credits and not uc, they may backpay last months as you had uc from then and so would of been eligible for that payment.

I've had a decision for disabled element and they've agreed special circumstances, not heard anything about carers element yet though but all my previous statements have been updated to show carers element and both elements are on my statement for this month (next week).

This is a message from my journal.
The elements can only be backdated to the same day the benefit started if you were in receipt of Universal Credit at this time. Your claim started on 18/07/2024. If you would like to request for your claim start date to be backdated please let me know and provide a reason this should be backdated

@GemzZ92 the disabled child element and carer element are still subject to the earning’s deduction. So if earnings still wipe out the total of all the elements, including the carer and disabled child element, you won't receive anything for those APs.

@CyanFawn sometimes the decision is made at the same time, other times it is not.

@Sim8 UC disabled child and carer elements will only be backdated to the start of the UC claim. That period would be covered by the CTC claim. Contact CTC if you were on that at when the DLA award started. For the backdating, explain the decision has only just been made.

Yes, they are ignoring my attempts of getting an answer to when they will be back dated.
Ill phone them Tuesday and say I wish to make a complaint too and see if that helps.

Apparently you should have a letter uploaded to your journal stating what they are paying back. Have you not had this?

Yeah I would, it was nearly a month before I did, but when they'd been ignoring me yet put on I now owed money due to carers allowance backpay and someone would be in touch I was just like nahhh they're taking the mick.

I've had 1 letter on my journal so far to say the decision maker had agreed to special circumstances and it will be backdated, nothing about the carers element and nothing about when or how much.

@SearchingForSolitude thank you so much really appreciate the response. I was on CTC when I got dla awarded last year and Now I'm on UC from last month. So I will call CTC. Do I need to reply bk to the message in my journal and what reason can I put.
