In court for ABH because I snapped

I had a mentally abusive partner for 4 years, paired with his teenage kids who hated me and his ex wife who detested me. Added to this I was already set up as the mad woman with his family(I was honest and told him of a previous mental breakdown).

I'm due in court on Thurs and cannot get legal aid, even though, this is becausec of them and their actions, I am now homeless, living in emergency accommodation. All I did was throw a plastic bin that hit him in the head. Immediately the police were called, as if it were all planned to get me out of the house (strangely a joint tenancy).

How do I go about proving their lies and malice, spite and vindictiveness for which I have no understanding where it came from?

His kids told everyone I was vile and horrible, when the worst I did was say no to them. These kids have no boundaries and their parents moddycoddle them.

I have given these kids a lot in terms of time, love and money, but nothing worked.

Advice please?

I'm now wishing I hadn't asked as according to this thread I'm endangering children, throwing wheelie bins and all sorts!

I have already pleaded guilty at the police interview and intend on being accountable for my actions.

I am not looking for an out, I was simply asking if anyone had any advice on going into court without a solicitor.

I'm sorry people are attacking you. Please contact womens aid and tell the truth. Often these partners are abusive and we react to the build up of abuse. It's reactive abuse.

Yes, the moulded bit on the bottom cut him and he was bruised, I am not denying it.

Would there have been a suitable solicitor for you on the Law Society's database, OP?

It would have been good to speak to one today.

I'm wondering whether it would be worth touching base with the Duty Social Worker in your area tomorrow; your situation is really sad and it would be good to know that someone could support you, even in some small way.

You did wrong, I've done worse, when I was in a dv controlling relationship I flipped and went wild infront of the police. I was in a refuge and collecting my stuff which he kept saying belonged to him and I couldn't take anything that belonged to him apparently, as it was his house and I had no proof I had to leave. It was my son's clothes and cot who was 13 months old. Had was just been nasty. He smirked I went wild!!
Police arrested me but they knew the score.
Anywhere I want to ask the question

I am not a lawyer @18Floral but I used to be a journalist and did the courts so I have some knowledge.

Most cases of ABH are heard in magistrates' court. Pleading guilty will mean you get recognition for your timely guilty plea when they sentence you ie a lower sentence.

If you really can't afford a solicitor (and I would recommend that you do everything you can to get one) you will be able to make some representation in mitigation for yourself. I suggest you write something in advance and ask the court to read it you could get a solicitor to help you draft it, but not attend court with you, as that would be cheaper.

Based on what you've said and my own assumptions I think you are likely to get a fine, but you could be sent to prison if you did him any serious injury.

If the magistrates think they don't have sufficient sentencing pets, they can send your case to the crown court to be heard by a judge. I don't think that's likely in your case unless you caused a serious injury.
