To think I can't return this

I bought someone an expensive water bottle as a Christmas gift. Today they handed it back to me and said I should return it because its only single walled so condensation develops on it when they put icy water in and I should try and get a refund. Partly my bad, it didn't claim to be double walled and I didn't think of it when buying, for me it doesn't matter as I just fill from the tap and keep it in my bag on my desk. They maintained this water bottle is not fit for purpose and should be returned under distance selling laws. I don't think I have grounds to return it on this basis. I'm not sure what to do, they insisted they didn't want me out of pocket for something they can't use, but what should I do? I'll happily take it and use it myself if they don't want it. I can't return this item can I? I know this is trivial!!

tbh I would try and send it back it was £40
many bottles aren’t insulated
but I wouldn’t give them anything

at an extreme push they might of done it as they didn’t want to waste your money rather than keep it and say nothing

Those Georg Jenson bottles are beautiful. Your friend is unbelievably rude. I have several water bottles and I've just checked...none of them are double walled.

Genuine manufacturers don't make spelling mistakes on their packaging so you have a fake. Just on principle, you should notify ebay and insist they deal with it. It's not ok for sellers to be selling fake stuff.
Don't feel sorry for the seller, they know what they're doing. Did they actually send it to you themselves or drop ship it?

Because if they thought I knew it was fake and thought they wouldn't notice, that's very embarrassing and not what has happened. I'm not fully convinced it is a fake because it looks so good but the error on the box suggests it might be. I'll see what the seller says and I think I will email Georg Jensen. I should have brought the bottle home with me but I was a bit stunned at the condensation complaint so I think I just said they could give it to charity or sell on Vinted if it wasn't suitable. I'll go get it tonight

It looks like a fancy bottle, but very odd that the description states that the strap cannot cope with carrying the weight of the bottle. So it’s decorative only? Perhaps GJ should leave premium/expensive bottle design to the big girls, ie, Stanley.

Drop ship? I'm not sure what you mean, think it arrived Royal Mail - the seller might not have known like I didn't know

Send Georg Jensen customer services a photograph of the typo and ask them about it. I think they will respond as they are a very good company and would definitely want to know if somebody was marketing fakes of their products.

If it does turn out to be a fake then you absolutely should ask for your money back, otherwise I don't think you really have a case. The recipient of the gift is certainly being rude, it's U to keep a gift that long then complain.

I do think it's a beautiful water bottle, my main reservation would be that the stainless steel would get scratched very easily. I have a single skinned water bottle myself that's metal, it never gets condensation, but that's because I only use it for water from the tap and don't try to put over-chilled drinks in it.

This is the best advice on this thread. Contact GJ, send photos of the box. They may well call you. I had this with a fake item from Cross pens, they were on it immediately.

If it’s a fake then you should get your money back, regardless of whether it’s double or single skinned.

Recipient might have been being rude or might have been trying to tell you tactfully you’d been conned.

i would feel awful returning a "mispurchase" to a small company.

If you can use it i would do that, and the recipient gets no present this year for being ungrateful

it's a Danish company. All of you "oh no grammar error it's fake" can pack it in. Unless you could write that in perfect Danish.

It's not an insulated bottle as it's only for cold drinks. Though the strap not being strong enough for a full bottle is silly.

I've got one of these bottles - and no, I don't use it because it doesn't keep chilled drinks chilled! It was bought as a birthday present from my old boss, so it just sits in the cupboard looking pretty 😳

I'm hoping the attached photo works, showing the wording on the back of the box of the one I've got (Sky model in rose colour).

Seller got back to and insists the bought it in Australia directly from a Georg Jensen shop there and that it is genuine. I need to get the box before I can take it further

I think that's the plastic version, I bought the stainless steel - eta sorry I didn't see there was a previous post saying you have one of these. It could just be GJ are not that great, I always thought they were synonymous with great design and I could take that for granted

I gave up buying new items on eBay long ago. They were either always faulty, obvious used returns, or factory seconds, and not described as such. Even from established retailers with an additional eBay presence. It's great for pre-owned and vintage stuff, but not 'new'.

If you can use the gift yourself, then keep it. Don't return it, and don't give an alternative gift.
In future, either do not buy a gift, or instead buy vouchers.

Heh, you'd be surprised. Just as an example, Lego put out a new Star Trek set late last year. Around £300 so not a cheap bit of kit. One of the pieces had basically the most famous quote from the show on it "To Boldly go where no man has gone before"

Except they didn't, because they'd missed a letter, so it was "To Boldy go"

They had to send out a whole load of replacement parts to people, which ended up also being wrong in a completely different way. So they're now sending out a 3rd version of the part.

Even company's like Lego who are known for being high quality and detail oriented make cock ups like this on occasion, and they're not alone. Pretty much every first edition of a book will have a misprint or two in it. Hell, even the royal mint managed to create a load of 20p's a few years back that completely missed the date off them.

Something having a spelling error is no guarantee that it's a fake

If it's within 14 days is the key part for distance selling. Using something does not prevent this being applied. In fact using something is the only way you can assess the legally protected right to establish the "nature, characteristics and functioning" of something you buy. So you can use it, return it, and get a full refund.

The law only says that if you use it beyond what is necessary to establish this, then the seller can deduct any lost value from your refund - but you can still return it regardless and get a refund even if you do use it more than justified. You can still technically go through the motions, and they would have to process it as a return, even if the deductions are 100% of the price you paid so you get no refund. Obviously at that point, its better to keep it if it works even slightly.
