To think I can't return this

I bought someone an expensive water bottle as a Christmas gift. Today they handed it back to me and said I should return it because its only single walled so condensation develops on it when they put icy water in and I should try and get a refund. Partly my bad, it didn't claim to be double walled and I didn't think of it when buying, for me it doesn't matter as I just fill from the tap and keep it in my bag on my desk. They maintained this water bottle is not fit for purpose and should be returned under distance selling laws. I don't think I have grounds to return it on this basis. I'm not sure what to do, they insisted they didn't want me out of pocket for something they can't use, but what should I do? I'll happily take it and use it myself if they don't want it. I can't return this item can I? I know this is trivial!!

I don't think a error like that screams scam at all. They are a danish company and it could be a genuine error. I got some tea bags from a british company and the blurb said "we may be bias" instead of "we may be biased" - I was itching to email them and tell them but then couldn't be bothered.

Were these £60 tea bags? People generally have the sense to apply relative standards. I wouldnt think twice about a pound shop product having a spelling mistake either. I would hold the same product being sold at £50 to a higher standard, and not support that company if they had spelling mistakes. It's the most basic first impression of that companies quality and ability to get things done - if you screw up the easiest part of spelling on the packaging, I'm not trusting you with a lot of money (relatively speaking).

They came in a hamper that was sent to me. It was from cutter and squidge. So not a cheapie. You are absolutely spot on though, due to that mistake I would not buy the tea bags separately. It takes nothing really to get someone to proof read the blurb.

I love my MIL and SIL dearly, we're very close, but this is one thing they would do.

They sometimes give presents back - even small things like a certain type of coffee - if they don't like it. In their mind it's because they think it's wasteful if it doesn't get used but I would NEVER do this.

I would just regift the present if I already had something similar or if it wasn't too my likely. Or see if I could return it myself without letting them know. Or give to charity.

People are funny (and rude).

The seller can easily seal up bags with a bag resealer

Are they serious! How rude. They probably want you to give them the money instead. I would say, I’m not going to return it, shame you didn’t like it though.

Seller got back to and insists the bought it in Australia directly from a Georg Jensen shop there and that it is genuine. I need to get the box before I can take it further

Hey op You go back to the seller and say ok I was going to email them anyway to see if it’s genuine so if it is you won’t hear back if it isn’t I will report to eBay as it’s misold this might scare them into a refund but it’s very expensive for carrying water either way,

I think that if you like the bottle yourself, then just keep it.
You know now that they are single walled as lots of bottles are. There's no point making it more of an issue and reporting fakes just because your friend is weird about gifts

Yes you can, within the time limit for distance sales obviously but you can. A time limit extended by a long time if the right information in the right way isn't supplied at purchase.

Nothing in the law says you can't use it. It's one of the nonsense things businesses have spread over time, like the many that try and make out you need the original packaging to do it when this isn't actually true.

No extra barrier to a statutory law can be added that isn't in the law, and it being used isn't a barrier in the law, same for packaging requirements, and so it can't be used by businesses. In fact it being used is clearly detailed as something possible in the law so the very opposite.

It is fit for purpose (holding water) so I don't think you have grounds for returning it. Whoever you bought it for is being unreasonable and ungrateful.

An error on the box suggests a fake. I would return it.

I see text errors on plenty of things that aren't fake so I don't think that's very telling.

I think that's the plastic version, I bought the stainless steel - eta sorry I didn't see there was a previous post saying you have one of these. It could just be GJ are not that great, I always thought they were synonymous with great design and I could take that for granted

Great design doesnt mean great functionality though tbf

It strikes me to be more about the look than the function (especially as the handmade calf leather strap cant actually support a full bottle)

No they aren’t. They are £60 on the website.

There is a plastic bottle for £15 but that’s not what the OP bought.

Quick update - took a while to hear back, but Georg Jensen Australia confirmed they do have stock with this typo, so it's not a fake, it is genuine.

And on that basis I really don't think I can return the bottle!
