To think I can't return this

I bought someone an expensive water bottle as a Christmas gift. Today they handed it back to me and said I should return it because its only single walled so condensation develops on it when they put icy water in and I should try and get a refund. Partly my bad, it didn't claim to be double walled and I didn't think of it when buying, for me it doesn't matter as I just fill from the tap and keep it in my bag on my desk. They maintained this water bottle is not fit for purpose and should be returned under distance selling laws. I don't think I have grounds to return it on this basis. I'm not sure what to do, they insisted they didn't want me out of pocket for something they can't use, but what should I do? I'll happily take it and use it myself if they don't want it. I can't return this item can I? I know this is trivial!!

That was unbelievably rude. I'd keep it for myself and never buy her another gift.

If it hadn't been used, and was in original packaging then it could have been returned. Under distance selling, you can return an item just because you changed your mind, as long as it's unused and in sellable condition (although you may have to pay postage in this scenario).

I don't really see how a water bottle getting condensation would make it unusable or unfit for purpose. Unless it claimed to be condensation free or something in the description, I imagine the seller would understandably refuse to refund.

Having read the rest of your posts I also think she’s maybe trying to suggest that the bottle is a fake and should be returned on that basis. If it’s a well known brand that is double walled and the one you bought isn’t, is she saying ‘it must be fake because the real ones are double walled’?

Yeah this is weird for the friend to be telling you this. I also wonder if they want you to get the refund so you can give it to them.

Posters are saying they’re rude but I think she’s just trying to make sure you’re not scammed.

You say it was expensive and she’s saying it’s not fit for purpose.

It’s a tricky one because you bought it and it was your responsibility to check the description of it.
But if says it’s double walled and it’s not then you can definitely get a refund.

When you said expensive I thought you meant about £15.

If I were them, I’d be disappointed and frustrated - a lovely water bottle that condensates leaving water behind it would be very annoying. So I’d have to consign it to the back of a cupboard and buy a cheap one which works. (Unless you work with them and would see they weren’t using it).

It is rude of them to have given it back to you; it doesn’t sound faulty so probably no chance of returning it.

AND £40 on a water bottle 😱

It's not a Stanley, it's not a common water bottle design, I've looked on the website and can't see anywhere it is supposed to be double walled. But looking at the box there is actually a grammar error... So now I wonder if she does think it is fake. The quality of the water bottle looks excellent though, with the error on the back of the box do I perhaps now have grounds for a refund?

I'm so unbelievably embarrassed if this is a fake, the seller had 100% feedback

What makes you think it was worth £50 or £42 if it’s not insulated etc? Is it personalised? It’s a huge amount of money for what sounds like a very standard water bottle? If it’s personalised returning may be impossible since there’s no actual fault with the bottle. If it’s a fake it would surely have to be a brand?

Is it a fake? £40 for a single walled water bottle is steep! I wonder whether the originals are double walled as standard and thats why your friend thinks there’s something wrong with it.

Also I get not wanting a bottle that gets covered in condensation - it’s going to make everything in your bag or wherever you keep it wet.

Is it a genuine one though, seems very expensive if not double walled. Check the manufacturer to see if it’s meant to be double walled.

If there's a spelling/grammar mistake on the box it's a fake and that will serve as your proof.
. You will be covered by eBay money back thingy so if I were you I'd return it, it's a lot of money for something you didn't intentionally buy for yourself.

Agree, buying it on eBay and an error on the box sounds like a fake. Though doesn’t change the insulation problem for your friend.

It’s a pretty water bottle so I can see why you picked it as a present but I think the website is worded in a clever way - not suitable for hot drinks and chilled only - presumably because it’s single lined and stainless steel. I don’t know if I’d have spotted it, but I think if it’s not a fake (which it might be) it’s working as designed. Unfortunately.
