To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

I agree with you but I know for a fact with a private parking lot they will decline your appeal regardless.

I would advise paying whilst it's cheaper

It's annoying but not much you can do

TheWalrusdidbeseech · 03/07/2023 16:39

there's no chance you'll win an appeal with these photos.

Peony654 · 03/07/2023 16:40

I'd say you've got no chance and should just pay now before it increases

kafkascastle · 03/07/2023 16:41

I agree it is his bay. The striped area is for getting his child/baby in and out. I would appeal on those grounds.

PotteringAlonggotkickedoutandhadtoreregister · 03/07/2023 16:41

He wasn’t parked in the marked bay so I wouldn’t appeal, I would just pay.

Clymene · 03/07/2023 16:41

Unless the other car was also parked over the hatches, no chance.

PuppyMonkey · 03/07/2023 16:41

That’s really annoying, OP.

Hungrycaterpillarsmummy · 03/07/2023 16:42

Is it a private company? If so, you don't have to pay.

chupachucks · 03/07/2023 16:42

I think your slightly slightly onto the hatched area and mine are different. Id say that's a dam sight more than slightly and if he could not park in there fully park in another bay not just parent and child.

Pay the fine.

LadyDanburysHat · 03/07/2023 16:43

He could have reversed in to have more space to get the child out. But also how close were they? You can get a child out in a normal space. I'd just pay.

Sirzy · 03/07/2023 16:44

The hatching aren’t for parking in, the marked space is. So he was parked out of the markings so it’s a fair fine

Lacucuracha · 03/07/2023 16:45

Is this what’s shown in the pic? Because it looks like he would had enough space if parked within the bay? Or is this a pic after the large car left?

I would definitely appeal, private parking firms are assholes but POPLA may be sympathetic.

Tell that to the civil court if they decided to take you 🙄

Always one.

Luxell934 · 03/07/2023 16:47

I think It’s wrong you’ve got a ticket for that personally.

but even if another car was parked massively over the yellow markings I’m not sure why it was nessesary for you to park like that on -an angle.

BaronessEllarawrosaurus · 03/07/2023 16:47

Our council car park states you must be parked within the marked parking area, you would be booked for parking on the hatching.

Toniii · 03/07/2023 16:47

I'd pay the fine. But I agree it's ridiculous to be fined for that when he's not obstructing anyone else's bay.

SliceOfCakeCupOfTea · 03/07/2023 16:49

Unless the other car was massively parked on the hatchings, your DH did not need to put his wheels on them. There is plenty of space to open the door and get a baby out.

Even if other car was too close, there are 2 sides to the car so he could have got baby out the other side and still parked correctly

FudgeFlake · 03/07/2023 16:49

I'm assuming your photos are afterwards, by which time the big vehicle has gone. So you have no proof that your husband felt forced to park a bit out of the bay due to someone else's inconsiderate parking, unless the store has cctv covering the area and is willing to share it with you. Frankly I'd suck this one up, not worth the hassle and the blood pressure!

picturethispatsy · 03/07/2023 16:50

I’d appeal 100%. It’s a ridiculous fine. He’s hardly obstructing anyone. Can I ask is it a private parking company? I’ve recently appealed one (via the company whose land I was parked on) with a certain private company (P.E) and won. I really persevered with it, wrote 3 letters of complaint (one to the CEO of the supermarket) and it paid off.

changeyerheadworzel · 03/07/2023 16:56

Absolutely stupid to fine someone over this.

I had a ticket for parking in a McDonald's car park. Didn't pay, nothing happened. Big deal.

"There's always one" yeh, cause it's true.

Yep so every one can now do the same can they because you got away with it one time, oh please.

This isn't really true.

OP, I think you are right logically, but I don't think you'll get anywhere as the markings indicate that noone should park in the crossed out area, so if there is a cheaper option for paying striaght away I would jsut suck it up and do it.
