To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

All that space and he couldn't straighten up?

Apart from that he's not in the space properly, the hatch markings are to allow the doors to open. Just pay up and be done.

Good variation in responses! To answer some questions:

Yes it’s private, but they’re known locally for being very picky.

There was another car close by when he parked, but obviously not when the warden came along.

The pictures are what were sent to us as evidence - infringement was 9 days ago.

It does say if you appeal within 14 days it’ll pause at the lower rate while it’s considered.

Definitely not obstruction of a pathway - the hatching is either side of the spaces for parents and child.

Seems a bit petty to give him a ticket but then I don’t understand why he could not park considerately within the lines. I mean he had enough room to get it in to the bay straight.

He didn’t park inconsiderately, the entire space is allocated for one car. It’s income generating jobs worthiness. What kind of person would issue a ticket for that?

How do you know this? You mean that it does not hinder access to the stores for people with trolleys, parents with prams and wheelchairs. To be honest your making that up.

Hatched area do not park and if you cannot park responsiblely in that space park else where in the car park and stop being lazy.

I'm pretty certain the notices will say park within the parking bay lines as with most parking signs. The parking lines are for one car not the hatched area. Your making it up as you go along 😂

Your husband needs to actually park properly if he couldn't park in the bay properly because of someone else then he should have parked elsewhere, and all what you have put are poor excuses.

To those who say don't pay it , it's not that simple now.

From citizen advice:

If you decide to do nothing
If you get a ticket for parking on private land and you don’t think you should have to pay, you can decide not to pay and not to reply to the parking operator. The company may continue to send requests to pay and you could continue to ignore these.
Private parking operators could take you to court, but they may choose not to do this, as the amount of money being demanded is usually quite small.
Keep the ticket and any other paperwork or evidence.
If the parking operator does take you to court, you may be able to defend this, for example on the grounds that the signs in the car park were unclear.

As the mother of a wheelchair user people parking on the hashed markings makes life so much harder than it needs to be. It is inconsiderate, those markings are out there for a reason and it isn’t to park on.

surely if it was going to be tight on one side he could have reversed in?

Are you certain? Just because it looks like the space is right outside the doors so that would be the most logical walking route to the rest of the car park. The ‘space to open the doors’ isn’t usually hashed like that is it? Hashing would indicate, I think, that you shouldn’t park there. I know the picture doesn’t tell the whole story re access though. And because there is the hashing on both sides he may have been over on one side but the other side was wider so actually he didn’t block anyone’s path because they could pass on the other side. Since it’s paused at the lower rate if you get the appeal in now then may as well give it a go? Say that it looked like part of the space i.e. to open doors and no access was impeded. I don’t think it’s likely to succeed but sounds like you have nothing to lose. Good luck!

My husband just got a ticket for parking slightly over the white lines in a normal parking space. He did this as the car one side of him was parked practically on their line and if he'd parked within his bay they wouldn't have been able to get into their car. Car park was very busy and he'd been waiting for a space. Despite having photos to show other car right on their line, the appeal he made failed. It's just ridiculous to fine someone for being considerate to other car park users.

If he got baby out driver's side there should have still been room to park within the bay. The hatched area is clearance not part of the parking bay, He could have reversed in were the other car an issue. Tbh he was lazily parked and an appeal will not succeed,

Gonna echo others gotta be in the lines. The markings are for the doors to open I guess never a thing when mine were little. Off topic he's clearly struggling to park the Volvo im guessing he's a new driver? Have you thought of a smaller car for him ?

That's what I'd have thought.

I thought this thread was going to be one of those where an unreasonable fine is given by a jobsworth because one tyre is touching the bay lines.

In this situation he's not parked in the bay and could have reversed to give clearance on the child side.

Of course appeal it. These companies are robbing so-and-sos. I took one to a POPLA appeal and won, they didn't even challenge it.

Google Pepipoo parking, their forums are helpful. Also try googling "parking fine + <name of car park>" as you may get examples of successful appeals from others who have been in the same situation. That helped me in my appeal.

Off the top of my head, you could argue signage isn't clear, or if there isn't actually signage at all that's a big one in your favour. Check the appeal forums - the company will reject your appeal but you can then go to POPLA. Never base your POPLA appeal on just one point either, get as many together as possible. I wrote a real essay and I think they may not have responded partly due to the time needed to respond to the myriad points I argued. 🙈 Was worth my time though!

You get he fine because of what you do, not because of what other people parked do. If you can't park within the lines park elsewhere.

It's often worth an appeal. Mention disabilities and the other car. There doesn't look like there is any reason they should give it to you but you never know. My friend recently got off a fine from a private parking company by explaining how he suddenly needed the bathroom due to his disability. I was surprised he got away with it but I saw the paperwork so I know it was true. (He was lying 🤷🏻‍♀️)

Keep the appeal very short and sweet and don't say silly things like he parked 'slightly' over the line when it's well and truly over the line.
