To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

Obviously he’s not in the centre but I thought the entire thing was the parking spot.
He’s not stopping anyone else from parking in the bays next to him.

I think the parking ticket is ridiculous although I’m not sure if I would contest it because chances are they’ll decline it and you’ll be paying lots more.

Are there signs saying to park within the centre lines?

How can you think the hatched markings are the entire spot? That would completely defeat the object of their existence.

It’s quite scary the amount of people who seem to think a sign is needed to tell people how to park! Putting your car between two lines shouldn’t be tough.

If it’s a private fine surely you can ignore it as it’s not a council fine.
Also some people on here need to avoid being keyboard warriors and actually give advice, not slander her DHs parking job. I wonder if some of you could do better given the circumstances?

You can also appeal and state you weren’t driving, therefore they need to find out who was driving. You don’t have to tell them either, as it’s not a police NIP
They send the registered keeper the ticket, they are guessing the registered keeper was driving… if not they can’t go any further
its a game and they don’t play by the rules so why should you

Parking operators in England and Wales are allowed to hold the vehicle's owner liable for unpaid charges if they don't know who the driver was and the owner refuses, or is unable, to name the driver.

So again more inaccurate advice, why do people insist on making false statements.

If it won't cost you more to appeal the of course appeal!

You're within the marked car parking space, as in, you're not in someone else's space impeding their ability to park. It's also almost impossible to align within the marked bay which is ridiculously narrow - you could be forgiven for thinking deliberately so!

I'd suggest you take a big bite of your own advice. It may be legally unenforceable, but parking on private land like this with signage up opens the OP up to civil court and small claims court it's not a fine it's a charge for a contract the aOP make with the land owner when he parked his car on their property.

@ParkingfineWhine I'd appeal. I think the warden has been over zealous.

Given that the next bay along where the black car is parked is a standard bay, the 60cm width of hatching is for your bay and your bay only. It is not required for access in and out of the adjacent car in a standard bay.

If it had been another accessible bay parent & child/disabled then he would have been at fault.

There's no way I'd pay the fine for that, that's ridiculous! One of the reasons I hate this country and the silly rules.

I appealed a parking ticket and won, I just said sorry and that I had not followed the rules on reflection. Sometimes you might strike lucky.

Private parking companies don’t put tickets on the car. Council parking tickets get placed on the car.

100pc I would appeal that. Another car was blocking the space and you therefore had to move slightly across to make use of what is left.

Also the whole hatched area could be considered your space anyway

The money won't go up for a declined appeal surely - I would go for it

@LoopyLoup That link is for parking penalty notices. The OP has been sent a charge for breach of contract with a private party.

That page is not relevant to this case I'm afraid.

That's some shocking parking, and if he wasn't confident he could get the child out, he should have gone in search of a space that would allow him to do so with ease, or, reverse parked.
