To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

Go to peppipoo or money saving expert and ask on there. You'll get factual responses on how best to appeal rather than made up opinions on here.

What disabilities, it is a parent and child space.

Yes, I would appeal but unless those photos are time stamped, it will do you no good as they will assume you mostly fixed the car before taking the photos.

I would ring the parking company though and appeal

Not a chance. Ignorance is no excuse I'm afraid, neither is common sense. You've flounted the rules. You didn't need to go over the line. You did so to give yourself more room. You could have managed without doing so.

There are hatched areas on both sides. So even was a large car parked on the drivers side, there was PLENTY of room to get the baby out due to the hatching. That's the point of it! He didn't need to park even further over.

People that do this sort of thing think themselves very clever. However what they don't care about is that it tends to rebound on people who genuinely have disabilities, because then things like this are clamped down on for everyone, which includes people who are telling the truth.

It's a despicable thing to do, and the fact he was boasting about it shows what sort of person he is.

That’s really harsh to fine you! The inner box is quite small, though your car isn’t large. I would appeal.

@LIZS people with disabilities are entitled to reasonable adjustment for their disability (even if they don't have a blue badge). It's reasonable to assume that use of a parent and child space would fulfil that criteria (which is what I assume the previous poster is referring to).

You said "what disabilities it's a parent and child space" - or roughly that - and I was just saying that people with disabilities are entitled to reasonable adjustments under the equality act and that use of a parent and child space would fit that criterion (which is why the other poster's "friend" lied).

The hatched area isn't part of the parking space. If it were, it would be redundant and the space would simply be for the full area.
He's parked way over the boundary line. He's also not got a valid justification, as he should have reversed into the space if the cat to his right was too close. He actively chose to park in that way, in that space. I'd honestly feel embarrassed posting those pictures.

By all means appeal because you've got nothing to lose. But don't ignore it as others have advised to as the rules changed several years back and they now can and do prosecute.

The photos clearly show the car is parked outside the marked bay.

Not a chance in hell you'd win an appeal. Annoying, yes, but it is what it is.

YABU - I have kids and you don't need more than the hatched space to get them in and out - there was zero need to park over to one side to give yourself even more space on one side? I'd suck this one up to be honest

It depends where you are in the uk though.

In Northern Ireland the Protection of Freedoms Act 2012 doesn't apply and it's the driver not the vehicle owner who is liable. And h the burden of proof is on the claimant (ie the private car park company).

Traffic people do not look at mitigating circumstances. They go by facts.
is you car over the line? Yes.

so appealing is totally useless and will make your blood boils for longer

But not parking in the actual space wouldn’t be a reasonable adjustment.

people parking in the hatchings make life harder for disabled people in car parks!

@Sirzy I agree. But the way I read it was @LIZS was asking why A disabled person would be in the parent and child spaces.

And it's a lie and not a good idea in this case.

Are you kidding? The car has about a foot of the parking space left to the side of it. It would fit in perfectly fine; with ample space to get a kid out of the door because of the hatching 😂

Op no way will you get anywhere with this appeal. Just suck it up and tell DH not to park like a dick next time x

We've had it for years here. You have to be within the space and not going over the lines otherwise you're fined 🤷🏻‍♀️.

He parked outside of the bay. Yellow hatchings mean you can't park there. He could easily have reversed in. There's no defence here - just pay the fine.
