To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

How can you think the hatched markings are the entire spot? That would completely defeat the object of their existence.

Obviously I don’t think it’s the entire spot where you can park right over the other side to spot other people getting in their cars.

But I didn’t think you’d be fined for being just over the line.

I know someone who had a child with a wheelchair/adapted pushchair and she’d always park closer to one side and I’m sure slightly went over a couple of times too.

A number of us have already pointed out you are incorrect on saying this 🙄

Ok, no worries

Ive successfully appealed around 6/7 tickets for others

Just wanted to share what I’ve found doing this

but if I’m wrong, not sure how it worked?

Frabbits · 03/07/2023 20:39

TinySaltLick · 03/07/2023 20:24

100pc I would appeal that. Another car was blocking the space and you therefore had to move slightly across to make use of what is left.

Also the whole hatched area could be considered your space anyway

The money won't go up for a declined appeal surely - I would go for it

But it's not.

The parking space is the bit between the lines.

If you park like a dick you get fined.

VeniVidiWeeWee · 03/07/2023 20:41

Apologies,I thought I'd corrected that.

I had a ticket for parking in a McDonald's car park. Didn't pay, nothing happened. Big deal.

"There's always one" yeh, cause it's true.

Thats what my mate did …… and thought nothing happened.
They went to court, they won and she now has an active CCJ registered against her name. Check your credit file

foolish advice to give !

Well I think you could say it is at a minimum debatable - the space is larger to aid getting in and out the car

With extenuating circumstances it is worth go I think

At the supermarket I work at the phrase is "you must park wholly within a marked bay."

If you park you accept that.

veryfluffyfluff · 03/07/2023 20:53

It's not meant to be extra space for crap parking. Minimum standards must be met

WhileMyGuitarGentlyWeeps · 03/07/2023 20:55

I think you/your husband are in the wrong here - and you should pay the fine... You're not parked properly in the bay... you are being unreasonable @ParkingfineWhine

A helpful piece of anecdotal guidance

Same point, the concept of a marked bay in your instance is a little ambiguous, also would appeal that one

GoodChat · 03/07/2023 20:26

No, it couldn't. What do you think hatched markings are for?

They are for the accessible space whether disabled or parent and child.

The hatchlngs are shared when between accessible spaces. This space is at the end of row so is entirely for the use of that parking space and no other.

AnOldCynic · 03/07/2023 21:01

Abbimae · 03/07/2023 20:26

Erm you do realise the yellow hatchings are for both cars so he is obstructing

No, in this case at the end of the row they are just for this space. The adjacent space isn't an accessible one.

If you can't work out what a marked bay is and what not maybe you should retake your test.

It's irrelevant it should be treated exactly the same. Park within the space no problems.

Is it a private company? If so, you don't have to pay.

Incorrect, you could end up with. CCJ following this advice

Clarachuff · 03/07/2023 21:06

No wonder the country is in a mess. I would not pay...its a "scam" let them take me to court!

How is it a scam? They own the land and have marked out and put signs up. By parking a vehicle on their land you are accepting the contract they have laid out for you to park on their property

Not hard to understand for most normal people.

If you don't like their terms and conditions don't park on their property.

Clarachuff · 03/07/2023 21:15

"Scam" ohh you parked on a painted line now pay us £xxx. Ffs

ScarletWitchM · 03/07/2023 21:17

If they pause the time that you can pay the reduced fine in while you appeal (most of them do - ie you have 14 days to pay half the cost,) then it’s always worth appealing

VeniVidiWeeWee · 03/07/2023 21:18

Same as oh you crossed the solid white line they painted on the road, now pay us ££ fine scam 🤣.

If you read the signs they usually inform you not to as part of the agreed contract. Seriously no wonder our country is a mess with people who can't understand simple concepts.

Because that's a fair comparison.

@Clarachuff

OK.

You may think it unreasonable but the Supreme Court disagrees with you.
