To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

Depending on the wording of the signs you could also try arguing that if it says park in the marked bay……does it say anywhere that the hatched lines aren’t part of the bay? Because obviously they are connected to that bay for being able to open your doors wide. It doesn’t impact on anyone else.

It could well say don’t park on hatched lines…….go back and take photos of signs now if you are going to appeal so they don’t change the signs.

even if it does say that it’s still worth appealing. A judge may think they’re been petty and find in your favour. They may well not send anyone to represent them in court, that happens quite a bit. Or they may just back down if they think you’re serious about taking it all the way. That also happens.

I had a ticket for parking in a McDonald's car park. Didn't pay, nothing happened. Big deal.

Was it more than seven years ago as that's how long they have to decide whether to enforce it.

Six years.

I have successfully appealed two parking tickets.
Both were issued by private parking companies.
The first one was a in a notorious card park, where the signs displaying the parking information were not visible to the average driver. In a previous case involving this car park, the Judge had actually visited the car park and declared the signage inadequate.
The second was a church car park that indicated that a permit was needed to park there, but there were no instructions on how to obtain a permit.
If this is a private car park, I would appeal.
It seems very harsh for a minor misalignment of the car with the yellow markings.
I know that there is some legislation either recently enacted or due soon that prevents private parking firms from claiming sums of money that are not proportionate to the parking error.
Your fine will not increase while the appeal is ongoing.
Don’t be intimidated by fear of a CCJ at this point.
Also, I have known private parking companies to accept a cheque for £20 accompanied by a note stating that “ this is what you can offer in full and final settlement of the case” .
If they accept and cash the cheque they have then forfeited their “ rights” to ask for more and to take the issue further.

For people who are getting 5/6/7 parking tickets, your time would be better spent actually learning to park rather than contesting them.

I agree to some extent, I’ve only ever had one ticket (at work) for “not parking in a designated space” in a gravel carpark with no marked spaces. So guess I’m lucky I didn’t get a ticket every day I was at work seeing as it was impossible to park in a designated space!

Could have reversed in if there was a car too close to the drivers side.
