To appeal this parking fine? (With pics!)

DH has had this one through because he’s parked over the marked bay.

He had to get the baby out of the drivers side - when he parked there was a large car close by, so he’s gone over slightly onto the hatched area the other side.

The space next to the side in question isn’t a parent and child bay and therefore no one was obstructed or inconvenienced by his parking.

Surely the bay is the whole thing?

Would you appeal?

He isn't parked within the marked parking bay. The hatched area is the area which should be left clear.

Wow what a stupid fine!

I used to work in a library where the street parking fines were paid (don't ask... - council cuts) and people got them for all sorts of incredibly minor infringements. The staff who would look at the appeals were often unable overturn decisions as their own work is heavily scrutinised and pressured to only allow the appeal if there has to be a real 'error' in the original fine in some way rather than looking at any situation with 'discretion' or 'common sense'. Eg - someone was attending a funeral that over-ran so they got a parking fine. Pretty shitty situation but the breach was still there so enforceable and they didn't succeed at appeal.

The very worst part of the thing is I think if you appeal, you lose the ability to pay 'half the fine' or whatever discount by swift settlement. So you've got to weigh up whether you pay up quickly for less, or risk an appeal and ending up having to pay 100%. I really don't think your appeal will be successful here, sadly, so I'd just pay up :(

If you would still get the chance to pay a reduced fine if your appeal is unsuccessful, then I'd appeal. Nothing to lose.

That is a very generous sized baby/toddler parking bay... there should be the need to park on the hatched bits.

Is it a private company? If so, you don't have to pay.

This used to be good advice a few years ago. However, things have changed due to a landmark case (can't remember the name) so this is now very much the wrong advice.

It's so ridiculous I had similar in a car park on a level with nobody else on that level . It's just a license to print money but I don't think anyone ever wins an appeal

How many days after the event if parking like this did the fine come to you?

if it’s over a certain number of days 14 I think - then you can appeal on that single fact and win

Bloody hell, the other car must have had the longest doors in history for him to have to shift out of the bay 😂
I call bull shit, he's just crap at driving into spaces, even with huge gaps either side 😳

That space is massive, no excuse about getting the baby out! The crossed out bits look like they’re to keep clear so that people can walk through to get to the car park. Is this correct? That would make the most sense as to why he’s been fined because that would mean he’s potentially obstructing pedestrians with prams and trolleys. Is there anything to lose by appealing though? If the fine won’t go up then may as well give it a go.

He hasn't parked correctly so it's a legitimate fine I think.

If he was parked over a different bay’s hatching, I’d think the fine was fair. But the hatching is to allow space for the person parked in his space, not for other people in other spaces, so he’s only in his own way, as it were.
However, I have no idea if it’s worth appealing or not.

He should have reversed in if he couldn't park properly to get the baby out forward facing. He just needs to pay the fine.

It is 14 days, many of these private companies rely on you not knowing this and are lapse at not sending them in time - check the dates

You should always appeal because if you lose you still get the lower fine providing you appeal within 14 days.

Fwiw me or DH have never lost an appeal.

This. And I think I would appeal on this basis. It hasnt prevented anyone else from parking or effected anyone else at all.

It doesn't matter whether or not anyone else is inconvenienced, he shouldn't have parked on the hatched area.

You can also appeal and state you weren’t driving, therefore they need to find out who was driving. You don’t have to tell them either, as it’s not a police NIP
They send the registered keeper the ticket, they are guessing the registered keeper was driving… if not they can’t go any further
its a game and they don’t play by the rules so why should you

They’ll not going to let you win the appeal, as they want to make money 💰
you need to find a loop hole and there are a few that they can’t wiggle out of 😂

Since he took photos I would assume the ticket was placed on the car so the 14 days doesn't come into it.

Fucking nuts they've given a ticket for that. I would definitely appeal.
