Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #67

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

I mentioned way back on these threads that, at the age of 15 or 16, I spent a fortnight on work experience at the local hospital. The female changing room was quite large and had several doors, I clearly remember it because I couldn’t figure out which door was the exit and I happened to be leaving the room at a time no other staff were in there so couldn’t ask. I was worried I’d go through the wrong door and walk in on something I shouldn’t have!

With that in mind, I would have been really upset if a male member of staff, however they identified, had been in there at the same time as me, especially if there were no other females present. This was back in the 80s when staff had their uniforms laundered on site and so were expected to change at work, it was frowned upon to not get changed.
I wonder how those RCN top bods would react to teenage school girls having to get undressed in front of older males such as DrU?

I've never understood the problem with outing.

First, most people who know a trans person know they are trans.

Second, what's the problem with being trans? What's the problem with owning, accepting, embracing who you are? A person of sex 1 that wants to "present as" sex 2. This self acceptance should be the true trans joy.

TIM are not women and diluting them into the women category does them no favours. It's nothing but trans erasure.

I think the issue is that the GI is that they are literal women, and therefore not 'transwomen'. Any suggestion that they are transwomen reminds everyone of the fact that they are/have been men. Therefore, it is only acceptable to be known as a woman.

I'm happy to settle for some tomato sauce...I'm not fussy, I just have standards and that fermented fish sauce falls below them. DH insists of sprinkling it on cottage pie and it turns my tummy. I don't have a patio, sadly.

No I think your memory is playing tricks @HelpMeINeedWine . It's not common in my experience to have hospital changing rooms split by professional group. It's male & female, women & men. You often don't coincide with the other professional groups because shift change will be at different times, so it tends to be doctors in at one time, nurses/midwives whoever in at another time.

It may be different where there is a separate department, e.g. physios, OTs or SaLT. But the evidence in the SP vs NHSFife & DU was that there was no doctors' changing room, and some doctors changed in their offices I think.

As some of us are deep in the technicalities of toilets, can I ask about two loos I’ve used recently in clubs?

Both were unisex. They both had rows of cubicles, in club A these had floor to ceiling doors on, club B had gaps. They both opened out into a space with hand basins etc.

Club B had a male toilet assistant and fancy smelly things and lollipops, apparently hoping for tips. It also had a closed-off urinal section.

what’s the legality of this set-up? I thought if unisex, the cubicles should include handwashing or open onto single sex basins? Or is that only in schools eg that Scottish case recently?

Am I remembering correctly that there were separate doctors and nurses changing rooms? And so Dr Upton was not only using the incorrect one for his sex, but was also using the nurses changing room instead of the doctors changing room? I remember wondering why more wasn't made of the fact he wasn't using the doctors changing room.

I think the A&E consultants had a nice roomy lounge cum office cum changing room. But only for consultants. And I have a feeling that they may have all been women. Original flavour.

Not according to Document T. I like the clarity of its intent statement

"The objective of this requirement is to require toilet accommodation in non-residential buildings to be separate single-sex toilets, with single-sex shared or individual hand-washing facilities. Universal toilets can be provided in addition to single-sex provision and where space allows. Where there is not sufficient space to provide single-sex toilets, fully enclosed universal toilets should be provided."

I think the senior nurses and senior doctors each had a shared office of similar proportions from what we saw on the "treasure hunt" map that Dr Upton kindly entered into a trainee doctor cpd type poster event in the same year. It would have been in those rooms that admin was being done, eg, at the times SP met with her managers to raise concerns, and where Upton tracked down Elspeth for his Christmas Eve sob.

Doesn't seem very convenient or hygienic to me, to change out of potentially soiled scrubs in the same room that others are going to be working in on next shift, but I guess it is the sort of thing that develops when the actual changing rooms are so tiny and inconvenient, even before you notice that the lads are changing in the ladies!

There was also an on-call room for doctors that was seized upon on twitter, but that would only have been for the small number of doctors who lived far enough away from the site to need to rest there whilst on call.

And I'm having a large patio replaced next week. Room for 2 x large DH or 3 x smaller ones. Anyone interested just DM me.

I'm pretty happy to keep DH at the moment but I will be willing to confirm that anyone needing an alibi was here arguing that black is black and white is white with people who believe that black is powder blue and white is candyfloss pink.
