Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal.

19 January assuming that the formal corrections didn't meddle with that and there's no request for, and granting of, an extension of time. Such an extension would be unusual but then we're not looking at a usual case.

Timing with the election would be stupendous. Philipson waited until she the Labour deputy leadership election was out of the way before she started playing games with the guidance. I voted for her in that contest on the least worst principle. Lucy Powell being the only alternative.
Any chance the Darlington nurses decision will surface soon? Clear conflicts between the two judgments, leaving aside factual differences and these being first instance, might surely influence the appeal.

The Darlington Nurses case, importantly numerous voices of complaint in contrast to one brave complaint above the parapet of SP should have bearing on its outcome, positively I hope. That judgement will be scrutinised in minutiae. Any organisation government or otherwise can no longer use the excuse of no or few complaints for justification of a ‘free for all’ in SSS etc for half the population. Adequate provision for everyone is all that’s being asked for. Recruitment policies/processes should be crystal clear about what is/not provided and accorded to the law. I thought there was mention somewhere about ‘clear blue line on the issue’ apt I thought.

I imaging the judge in the Darlington Nurses case is very carefully cross checking every reference with the original judgements to make sure they are accurate. Plus, given the exchanges with Jo Phoenix I think he had a better grasp of statistics.

Remember to call it the Streeting Trial with optional 'on children' or 'of Puberty blockers on children' if clarification is needed.

The Darlington judge did appear less ideologically hostile and more ready to listen and learn than Kemp - while also having a much better grasp of timekeeping.
