TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

I know it's his job but DH trying to claw this back that by August someone said they might help with legal advice is really aggravating.

Something to be kept in mind is what it must be like to suddenly be treated as a wrongdoer, when up to then you have an unblemished record in the career you have given years to. It must be a huge shock and very destabilising and worrying.

Funny how Sandie's alleged racism is a huge deal, yet this male paedophile's isn't.

Double standards?

Surely not?

Scout2016 · 28/09/2026 11:29

And they are supporting her from the angle that she is in the wrong, and they will try to save her job despite her wrong doing.

Seriestwo · 28/09/2026 11:29

The implication is that if you don’t prioritise a patients gender then you age providing substandard care. Even if the thing that’s wrong with him is relevant to his cock.

that’s insane. Trans id convicted paedophiles deserve good care just as much as anyone else - that means recognising he’s a fucking big bloke when passing information on to clinical colleagues.

Yes the asymmetry is quite something. I think it’s noticeable as well that a nurse cannot expect protection from racist abuse from a patient. I do not have an answer to the problem of how to treat racist patients but it is infuriating when that behaviour is not even acknowledged by the health service side.

JM advice
DH My Q was about referring yr case for a legal opinion. U knew they were doing this?
JM But they did nothing about it
DH We'll come to this. They were going to look over yr fraft grievance
JM Yes
DH The officer confirms following discussion RCN wld continue to

support yr case
JM No action was taken after this despite me receiving this email.
DH Were u concerned at the point y'd received this letter
JM Despite it I had no confidence in RCN. I had no response following for sev weeks. I needed to meet someone in the office

it wasn't a transperson, it was a male pedophile from a male prison who racially abused a nurse who believed in biological reality.
You just carry on defending the pedophile though.

I'm not "defending a pedophile". Who this patient is and what crimes they have committed is entirely separate to the issue of nursing practice and how patients can expect to be treated in the context of a health setting when receiving medical care.

CohensDiamondTeeth · 28/09/2026 11:30

TRA's are always saying being GC is akin to being racist.

Then a male paedophile literally racially abuses and threatens a female black nurse, who didn't know his pronouns and was trying to ensure her patient got the correct catheter for his sex (thereby avoiding damaging him), we have a TRA saying "poor racist paedo" and giving a bad faith take on why JM would be traumatised by everything that happened, both the abuse and her subsequent treatment from her employer and abandonment by her union?

Some people are yet to have their "Are we the baddies here?" moment apparently. You'd think this kind of thing would throw it into sharp relief for them... but no, apparently not.

And she was probably feeling like she was going mad. It must have felt like she'd fallen into some alternate universe where up is suddenly down.

Cailleach1 · 28/09/2026 11:30

JM must have thought the world had turned upside down. A male paedophile, shouting racist abuse at her for doing her job, and it was even in accordance with what was on his chart too. You don’t expect much better from him, (being a male paedophiles) as he is a convicted sex abuser of a child/children?.

However, when those at the hospital and RCN admonishes her as wrong for not going along with this paedophile’s claim to be a woman, in the face of his screaming and racist invective, something is seriously rotten.

What would happen if she hadn’t bothered to seek a doctor for him, and just let him feck off as he wanted? Would his bits have festered, and fallen off? I’m sure a nation would mourn if such a thing happened to this male paedophile.

Have they had a witch-hunt for whoever put M on this male paedophile’s chart, I wonder?

I definitely think that nurses and all staff deserve protection from racist abuse by patients. I don't think that is under question is it?

SlackJawedDisbeliefXY · 28/09/2026 11:05

What is the behavior threshold to get you thrown out of a hospital without treatment?

I'm a retired A&E consultant & have had occasion to kick patients out of the department for aggression, actual violence, racially abusing staff, being drunken arseholes etc I had a very low threshold for ejecting patients who abused staff.

Gender dysphoria is absolutely a medical condition. That's not particularly controversial. Not all trans people have gender dysphoria, and therefore, not all would necessarily be distressed by misgendering.

So one can have gender dysphoria and not be trans?

Was the violent racially abusive sex offender perhaps actually “cis” and not trans at all? No true Scotsman is on the line, they’d like a word.

Appalonia · 28/09/2026 11:32

I fear he's trying to put words in her mouth

JM I had no confidence even after receiving the letter. I had no follow up
DH On p1227: email from you to RCN on Aug 9th? Is that yr email address?
JM Yes
DH So 2 days later?
JM Yes
DH Y're telling RCN that y'd thought about writing Gx letter which RCN said they'd look at

JM Yes
DH Then u say u want to delay writing a GX
Yes
DH U say thank you for the guidance and help
JM Yes, as I was anticipating help and support. No proper help from RCN came
DH It doesnt say that
JM I was looking forward to it

So in your experience, this patient reached the threshold for being ejected from hospital.

Yet, this patient, who did not have a life threatening condition, was allowed to remain and continue treatment?

How curious

Boiledbeetle · 28/09/2026 11:36

"DH U say thank you for the guidance and help"

Fuck me! Being polite in an email is now being used against her.

DH [reading from letter] There's nothing to suggest u had no confidence in the RCN following 7 Aug letter is there?
JM My mental state at time was traumatised. I need the RCN to take seriously and needed help. The RCN prev told me not to submit a Gx form. I thought wld escalate

a sitn that had shaken me.
DH Nothing you say suggests an issue
JM I had asked so many times and didnt get the impression I'd be supported
DH Re the urgent legal opinion referral. This was shared w you wasnt it? look at p1228-37

I do sympathise, but this is a textbook example of how not to approach being a witness in an ET.

SlackJawedDisbeliefXY · 28/09/2026 11:05

Saying no to a TIM?

Like the woman refused surgery because she wanted female care and a TIM nurse kicked up a fuss IIRC, and Dr Upton's testimony where he implied that a female patient who had requested same sex care who refused an intimate examination from him "because he was 'trans'" male might result in a patient being labelled transphobic and refused care.

Edited for a strikethrough fail.
