Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #64

TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

Jennifer's distress at being told to reflect was no less real than a paedophile's at overhearing himself being misgendered. So I don't understand why one is dismissed and the other indulged.

Why is it traumatic to be told to reflect on one's practice about the importance of being respectful of a patients' pronouns and identity?

I'm surprised you can't understand why it can be traumatic to be told not to give patients the best care possible. Respecting this man's pronouns would have meant substandard care due to his sex being more important than his gender. Being punished for not providing substandard care would distress any decent caring person.

Because one is a deeply debilitating recognised medical condition and the other is a person who is being told that she should reflect on her work practice - which as a nurse requires her to be respectful of a patients' identity and health needs?

I disagree that respecting a patients' pronouns and gender identity leads to poorer health care. Quite the opposite is true.

In any case, we clearly aren't going to agree, so will leave this point there and move on to listening to the next.

In order to cater to his health needs, she needed to correctly sex him. She did not do this it his face. He racially abused her.

if you were paying attention you would know that Jennifer wasn’t addressing the paedophile but was in fact talking to a doctor about the guy. It was in urology so biology was fairly relevant.

It is entirely unreasonable to expect the whole of society to change the way we think and talk about reality just because a few folks get upset by reality.

Waitwhat? We forcibly abandoned the idea of it being a medical condition about 15 years ago; it’s simply “who people are”.

DH U didnt have a f2f but u had phone calls?
JM I didnt fully discuss the issues and was being transferred from 1 person to another

DH On p1215: u had a call with an office on June 5th leading to an appt to speak to an officer on the 7th June
JM I dont remember much and was just told someone wld feed back to me. It was a v horrible experience for me. I was expecting to be told to come to the office

JM It was back to back phone calls only. My friends referred me to the Darlington nurses and CC as RCN werent responding to me. I was really worried I'd lose my career and was confused and crying and v shaken.
DH U did speak to an RCN officer though, by the 7th Aug and

discussed your case?
JM Where is that recorded?
DH Go to p? A 2 page letter from RCN officer saying thanks for yr docs and agreed steps to support you.
JM At this point as I wasnt able to meet in office I sent in my statement of what they needed from me

it wasn't a transperson, it was a male pedophile from a male prison who racially abused a nurse who believed in biological reality.

DH U dont remember about urgent legal opinion?

JM I remember they'd look into a legal rep and get someone to come into the office
DH There's ref to an urgent legal opinion at the top of the page. U knew by 7 Aug at the latest that RCN referring for an urgent legal opinion

Gender dysphoria is absolutely a medical condition. That's not particularly controversial. Not all trans people have gender dysphoria, and therefore, not all would necessarily be distressed by misgendering.
