Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #64

TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

JM It says is premature. Had been ongoing since the

incident and the urgency of the sitn.. It was said to be premature and it didnt seem they cared about my MH.

So in your experience, this patient reached the threshold for being ejected from hospital.

Yet, this patient, who did not have a life threatening condition, was allowed to remain and continue treatment?

How curious

To be fair I think it's much easier to kick someone out an A&E department than when they are actually an inpatient. It's likely they walked in so can just walk out again. You always have to give the patient the opportunity to reform so it would only be after they had a warning & continued abuse that I would eject them. I even once had to call the police to take a patient away who refused to leave.

Noted, perhaps a single instance of racism form an inpatient might not reach the threshold

JM This was traumatising for me. It was a nightmare. Not thinking of my wellbeing as a nurse. I was traumatised and my children scared of losing me.

JM They didnt address the NMC calling me a danger to the public. It gave me no sense of help. The union was meant to help me and stand w me at such a critical time in my life

I'd like to be allowed to engage (respectfully) with the discussions and the legal proceedings, even though I do not come from a gender critical perspective. I hope that others can accept that.

I was just thinking that it seems an unfortunate choice. A male dominated RCN choosing a male KC to protect the status quo of subservient women paying their dues to the menfolk. I hope the member is listening closely.

Catching up so forgive me if it's been said but - first comments dont mention she not only had racist abuse but he tried to attack her and was, fortunately, prevented from reaching her.

I don't think this is good for the RCN it just looks like bullying, I wish more people could see/hear it. So enraging.
