Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #64

TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

NC's point - he was not interested in the wrongs done to SP and all the other women in NHS Fife. Only in the 'wrongs' SP may have done to DU.

It's one thing to 'know' that's what was going on, but having it definitively proved is like a kick in the teeth.

Given he's not from a nursing or medical background, do you think he'd even considered what changing scrubs etc might involve? He should have done, but maybe he thinks it's just somewhere to hang your coat, not that that makes a difference if it says female on the door.

I really really do hope that workplace Regs get a mention, what with being the law and everything. I wonder if they get a mention on the RCN website (not a medical professional so no idea what sits on the RCN website)

It's quite devastating as a woman to hear this (presumably ordinary and not sex offender) male witness, who holds a professional job, demonstrate total contempt for the feelings and human rights of women, the majority of whom don't want to get undressed in front of men whatever their GI beliefs, and his disinterest in addressing this casual sexual harassment/ abuse even though he works for a union....

That's why all women should join a woman's union.

A lot of the time it is not malicious, the dismissing of women's issues, it is a lack of consideration. The thought does not enter their heads, it needs to be pointed out, usually every time.

And as a result got a legal judgment that said workplace regs were on the basis of biological sex

Yes I agree.

Even if it hadn't occurred to him on his own that there might be an issue with the fact Upton was in the women's, it was explicitly spelt out to him by Sandie.

We have seen his mentality before - what's the big deal, it's just one... not realising that the "just one" impacts on ALL the women.

Eg. Oh, it's just one bloke in the race, what's the problem? Well, he's ballsed up the results for ALL the women after him.

This is the realisation that women are People Too.

He said there can be lots of reasons why women don't want to take their clothes off in front of somebody else and mumbled something about body confidence. What he doesn't seem to get is that a reason like that is about you, not the somebody else in the changing room. And if it's about you, then you can wait until the room is empty, find a cubicle, turn your back, whatever you need to do to feel comfortable. You don't insist that the other people in the room stay and applaud your body to make you feel better, or leave/don't look/turn around.
