TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

DH there was also a disco between you and SF about some of the words you used and DU used in your confrontation before xmas - along the lines of
"this is the same as when they put a man in a female prison" and you mentioned you'd said something similar
DH was that a ref to a rather notorious prisoner called Isla Bryson?

Yes, from Thursday 6th Feb 25, in evidence to JR:

DU - she said it wasn't safe for me to be there, asked what my chromosomes were, said it was analagous to the recent case, I assumed Isla Bryson...
JR - hang on please explain exactly the prisons comment
DU - she said it's like the situation in the prisons.
JR -what did you think
DU - I assumed she meant Isla Bryson, that she was comparing me to a sexual predator, there was an argument over men and women's estates

Reading through, I’m so annoyed once again by the utter nonsense DU was allowed to spout, especially when being examined by NC. And at the constant needless interruptions from JR

Amd he failed to note that Sandie didn't know whether he was one of the dangerous ones or not.

And he did in fact turnout to be pretty damn dangerous.

It's quite devastating as a woman to hear this (presumably ordinary and not sex offender) male witness, who holds a professional job, demonstrate total contempt for the feelings and human rights of women, the majority of whom don't want to get undressed in front of men whatever their GI beliefs, and his disinterest in addressing this casual sexual harassment/ abuse even though he works for a union....

Meanwhile what about the workplace regs? As a union rep he should have known about these and so on that basis alone he could have supported Sandie’s case.

It was the utterly jawdropping moment when Upton said " biological sex is a nebulous dog whistle ", which I will NEVER forget!

It's not hard to see how they think they did nothing wrong in how they "supported" Sandie after his evidence so far.

He thinks Sandie, and by extension any woman, should just shut up and take their clothes off so as not to upset the men.

I don't see how the 2nd Q supports RCN. It's evidence they won't represent women even when the TW is actively behaving badly rather than simply being present. Makes them look more biased, not less.
