TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

It is beyond me why women contjnue to pay membership fees to any union which prioritises the desires of a miniscule number of men, over the dignity and safety of 51% of the population.

I hope that loads of nurses will start to join the Darlington Union. The institutions that present both inadequate value for money in any way AND active discrimination against women need to be hit by natural defunding.

SF support during investigation
DH any reference to GC or sex realist views?
SF only the context of Isla Bryson case

SP didn't mention the IB case in the original tribunal, it was alleged by the other side.

DH December 2024. Email in connection with an additional allegation added to investigation process that emerged after the investigation meeting had taken place. When did you become aware of the extra allegation of misgendering?

Its so annoying. Everybody kept making the assumption she meant IB, but when questioned its obvious it was merely an assumption by the witness.

SF MG was requesting it be added to the ET claim
DH did you speak to NP about it?
SF he may have phoned me if there isn’t an email
SF I had a conversation with MG about having an extra allegation added and a valid case of victimisation

SF yes a discussion around legal process. Norman and our solicitors Anderson Strathern (sp).
DH email from Norman P refusing to provide legal representation.
SF yes we had a discussion on a training day. Norman referred to a similar situation where he added a second claim

On the email things......

My ex was insisting that he had never had notice about something very important to a custody dispute.

I had changed email addresses in my organisation and no longer had a copy.

3 years after the date I sent the email, IT in my organisation produced the email, a complete trail of its digital path through the organisation and found a return receipt.

This was a matter wholly personal to me. In 2001. And they did the search and returned the evidence within 24 hours.

I smell a rat.

I think it was suggested by the doctor helping Dr Upton fill in the incident report on their system.

The Doctor that sent the email to everybody to condemn SP.

He didn't suggest she may have a case because he thought she was a perp not victim, and he should just say so.

He says he wanted to hear both sides of the event before- what version which features a man in the women's changing room could possibly put Sandie in the wrong? No one is disputing he was in there.

Why didn't he follow up on what he sees as failings around her concerns not being addressed? He must have known she wasn't the only woman put in that situation.

SF I would ordinarily advise a member it would be sent by case management with my contact details
DH did you say that on this call
SF that’s how I would usually end the call

Unions are pants at customer service. All my telephone calls to many services are recorded and they tell me this right at the front.

SF yes
DH we can see MG wasn’t enthusiastic about the decision. How much more involvement did you have?
SF don’t think I spoke to SP after that. Spoke to MG in case at disciplinary hearings I didn’t appear.
DH sickness period ?
SF yes Gillian Tait looks after my cases in my absence.
