TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

SF I attended that meeting with SP.
DH discuss or debrief.
SF We met in advance and debriefed in car park after
DH between first contact and 7th March?
SF I spoke with solicitor
DH were you aware of SP concerns about her representation?
SF not aware of concerns
DH re legal representation?
SF we discussed after 7th March meeting, concerns about SP not providing care and wasn’t right that was the first time she was hearing about it.

That was my charitable interpretation too - and even more charitably, that for some reason the number was left on instead of the email address, so it went nowhere, certainly not to SP.

If it's anything like most of these systems someone still has to physically enter the info.

Of course they want legal representation. Or is this another case where you have the state the bloody obviously for them to do anything useful.

Is that DrU's claims that SP had left a patient in a dangerous situation?
Something that I think was particularly despicable, and he shouldn't be let off the hook for trying to destroy her professional standing.

Oh but, you know, it isn't in the budget... How would they be able to pay for this guy if they spent the money from members on legal advice to help them uphold their work rights?

DH your notes your memory of any views expressed?
SF SP believed Dr Upton was a biological male and shouldn’t have been in the changing rooms and her concerns around that.

She desperately wanted to feel seen and heard by her union and I reckon tea and sympathy may well have meant her case took a different path and could have saved a lot of stress all round.

DH questions exploring your communications with SP. And your contact with MG solicitor. Any sense that SP was looking for RCN legal assistance?
SF no it was clear Sex Matters were funding and supporting.
DH how seriously did you take the case?
SF I thought about the health board and agreed with SP that the health board hadn’t adequately addressed her concerns.

SP in the past I’ve tried to advise members to focus on things other than the investigation which can be a long time
