TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

SF no I mean she said in regards to that specific case that she felt a man shouldn't be in the women's changing rooms. My understanding at the time was there was no policy in place specific to NHS but guidance from the EHRC and the EA wouldn't have stopped Dr Upton from being in there.

Right, so no common decency and social contract, which kept men out of ladies toilets and changing rooms since they were first introduced? What rubbish.

Following on from SF's evidence, does this mean that none of the emails from the RCN to SP will have her email address on them?

The cat brought one in. It chewed through the back of the a cupboard that at the time I couldn't get to and moved in. The poison took a while to kick in. It eventually died under the cooker.

Why does a nurses union close for Christmas?

Do they think nothing goes wrong over the holidays?

Compare that with the access and responsiveness Upton was able to get from the BMA.

Unions are pants at customer service. All my telephone calls to many services are recorded and they tell me this right at the front.

The very first thing SF told the tribunal was that his background was in customer services. Well, that has become evident. And not in the way he thinks.

Are member responses automatically appended into the management system?
Does this rely on the member emails including the correct case number?

SP didn't mention the IB case in the original tribunal, it was alleged by the other side.

I thought that too, and was surprised to see this a couple of threads ago

DH there was also a disco between you and SF about some of the words you used and DU used in your confrontation before xmas - along the lines of
"this is the same as when they put a man in a female prison" and you mentioned you'd said something similar
DH was that a ref to a rather notorious prisoner called Isla Bryson?
