Tempest v Rural Payments Agency Tribunal Thread 4

Previous thread: https://www.mumsnet.com/talk/womens_rights/5549122-tempest-v-rural-payments-agency-tribunal-thread-3

TT substack: https://tribunaltweets.substack.com/p/tempest-vs-defra-and-rural-payments

Tempest (a TW) is claiming discrimination, harassment and/or victimisation on grounds of gender reassignment. Central to the claim is the existence of the Sex Equality and Equity Network in the Civil Service (SEEN). SEEN has been granted right to intervene. Parts of the original claim against the co-chair of SEEN (Elspeth Duemmer-Wrigley) and another party (Andreas Mueller) were struck out or narrowed. Another claimant, PQ, is no longer part of the case.

I will also note that Elspeth still has a garden in need of seeds and water to support the ability of SEEN to be an intervenor in this case. The claim originated because she said "only women menstruate" and a search with her name and those terms at the usual gardening website should point you to her plot.

I have had three tunnocks teacakes……

And now i have none

If a beetle isn't in the room with a clipboard verifying the event, did it actually happen?

(I'd be prepared to take you at your word if you'd said snowballs)

I ate them verrrry sloooooowly

Whats the best way to eat an elephant? One delicious, savouring lick at a time.

Ooh ooh ooh.

Are you down the back of the filing cabinet at my doctors? (That's literally where one of my medical documents was found)

I may identify as a medical document in some cases - but to be a bundle I must intend to be, or indeed be fully present in a court.

Your medical information may be in me, but I may never be in your medical evidence. I am a primary bundle, a secondary bundle, and a supplementary bundle. We bundle together.

Just catching up so apologies if anyone else has made this comment already but it seems to me that J was tetchy with AL about the bundles until AL pointed out that bundle was the C's job. As soon as HH was asked directly, and continued to mess it up, J handed down more time and even offered help from his team behind the green door.

That seems quite outrageous to me. The short shrift he initially gave AL and then the length of rope he consistently gives HH and C.

Did anyone else think that?

WeareBeyondSupplementalBundles · Today 12:02

I wonder if they found me......

I was lost yet now I am found.
I was blind yet now I SEEN.

Madcats · Today 12:03

While everybody is waiting, and discussing biscuits, can I ask whether anybody has tried freezing Tunnocks? The suggestion popped up on X, but I’ve not managed to procure any to give it a go.

I did! Which is why I asked the question of responsibilities for bundles (which Bundles answered with knowledge of bundles).

Agree re Judge.

Jimmyneutronsforehead · Today 12:03

We are back.
HH - just to let you know, my clerk is sorting and there will be hard copies before lunch.

ED - yes, attended on line
AL -CS Race Forum is another x gov network,
ED yes
AL - not DEFRA nor RAP
ED no
AL the position was that the CSRF had invited SEEN to give a talk about SEEN,
ED yes
AL only AG person at the event ED I don't know, don't have info about attendance

But you know what they say about giving someone a length of rope...

He probably knows HH - he's likely pissed off at these London types coming in and making these BIGLY bundles that are supplemented and get lost. He hasn't seen the likes of this before.

Except when its lovely local HH and of course we can help you against all these baddies with resources.

Bundle disrcimination is real.

Jeez you need to set up a crowd funder.

ED no
AL the position was that the CSRF had invited SEEN to give a talk about SEEN,
ED yes
AL only AG person at the event ED I don't know, don't have info about
attendance
AL what interest did you have in this event, why did you attend
ED its a x-gov network, we had heard gossip about SEEN, our members had heard about it and asked us to attend so
we did
AL did you intend to disrupt or police ED we wanted to hear what was being said, they were a
new network,
AL do you always attend new network
events
ED I try to
AL did you attend the ethical vegan event at around the same time
ED it was a DEFRA event, I wasn't invited
AL do you have that?
ED yes
AL a letter from CS Race Forum (CSRF), addressed to you and colleagues of AG, it says please note we've have kept the text of your letter when responding, so it's the text of a letter of complaint that you made and the response from CSRF

Well, it sounds like AL and NC have the Bigly bundles with supplementary bundles because they actually have the bundles organised and at hand, as opposed to Claimant's counsel.

This question got asked in the previous thread.

@Kirschcherries · Today 11:07
It’s interesting the J has confirmed the ET is being recorded. I wonder if that’s a lesson learned by NC from SP.

All Employment Tribunals in England & Wales have been recorded since November 2023

Jimmyneutronsforehead · Today 12:11

ED you've said its a letter of complaint, its not, its a letter of concern, the sections in bold are a response to our concerns
AL whether complaint or concern, you are using your position as chair of AG to undermine SEEN
ED no absolutely not, this is me, doing my job, when my members raise concerns, I decided to write a letter of concern to sibling network CSRF.
AL second bold para, 'based on anecdotal evidence' 'we fear this may be taken out of context, happy to arrange a mediation meeting between SEEN and AG. Do you see that
ED Yes
AL another offer of mediation
ED yes
AL did you take up those offers
ED yes, we had a meeting with CSRF
AL just with CSRF or with SEEN as well
ED - just with CSRF
AL the first example says specifically arrange mediation between AG and SEEN, doesn't appear that happened

I don't think I've ever seen 'nother' written down before!

I had to look up whether it's a real word or just a speech thingy and apparently it is a real word and has been around since c 14th Century.

So there you are. Much learning occurring.

Boiledbeetle · Today 12:12

ED you've said its a letter of complaint, its not, its a letter of concern, the sections in bold are a response to our concerns

Didn't we have not a complaint but a concern in the Darlington nurses?

Wouldn’t the biscuity/cakey base become soggy on freezing and thawing.

The idea is that you consume it in its frozen state, like a magnum?

Yes, I found it puzzling that the absence of the claimant’s own bundle was somehow the fault of the respondent.

Just so! I was reminded too of another ED with "concerns"
