Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton, following Employment Tribunal judgment - thread #60

1000 replies

nauticant · 16/12/2025 22:37

Judgment was handed down on 8 December 2025:

https://assets.publishing.service.gov.uk/media/6936ce28a6fc97b81e57436a/S_Peggie_v_Fife_Health_Board__Dr_Upton.pdf

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.
Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal.

The hearing was live tweeted by x.com/tribunaltweets and there's additional information here: tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-005 and tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-bd6.

This was in a letter presumably uncovered by an FoI.

She hasn't told the truth. Its part of the ongoing lies and cover up.

"I no longer have the capacity to give the role the focus and momentum it deserves.” - Too right Carol - off you pop.

I wonder if Carol's best pal will come back to this thread to scold us all for saying mean things about Carol, us big meanies???

KnottyAuty · 17/12/2025 15:16

Gosh these threads are still going too fast to keep up with! Interesting how Peggie and Upton have captured everyone’s imagination. Possibly even more than the infamous Isla Bryson

I still shudder when I visualise those pink leggings... That photographer was a genius and aptly gave a visual representation of the issues facing us with this nonsense. It also resulted in "rapist gender". Despite being an unwelcome visual for me, it managed to bring down the odious Nicola sturgeon, and for that, I am grateful.

It seems to me that there's a concerted effort from certain quarters to portray SP as the villain of the piece. My FB feed keeps showing me articles about the judgement.

The likes, etc show that most are in support of SP, but the comments seem to be largely from TRA's. Comments from those in support of SP seem to be receiving TRA accusations of 'transphobia' or ridiculed.

Empty vessels make most noise, and people who are starting to realise that they've been well and truly had need someone to blame. I shall wish them the 2026 they deserve. Does that count as kind? I do hope so...

I'm sure that it does.

We got a drive by scolding. I might go take a wee look to remind myself.

She said Carol was lovely, wasn't resigning because of the SP case, and called us all big meanies.

She's not been back.....

weegielass · 17/12/2025 15:57

which thread number can I find that then?

I actually know Carol Potter, she is a friend of mine of longstanding. You’ve all constructed a persona for her ( based on assumptions and inflammatory newspaper articles) that I do not recognise.
There are entirely legitimate reasons why she could choose to retire this summer that you don’t know about.
You’ve all been a bit too about gleeful about the outcome, I think it is very unpleasant and not constructive at all.

@Wbeezer any comment on the new disclosures that Carol lied about her reasons for resigning?

Jumping back, our version of pax, trucie etc was "Keys!" with both thumbs up. I've never heard of any of the others before this thread.

I wonder how many other people's headspace Dr U has invaded?

Being entirely subjective and blinded by a close relationship,
I would argue that a close friend of CP is possibly the least best person to judge the way in which she has handled everything

That's because you're her friend, not someone who has suffered from the decisions she has made.

NebulousSadTimes · 17/12/2025 16:16

It is odd that he's the Hill so many are prepared to die on.

I wonder how it's working out for them. They'll not be the beneficiaries in the long run.

"Least best" is harsh. Sixth best option, surely?

Why have you posted a video of the NHS Fife investigation process?

MyrtleLion · 17/12/2025 16:41

Wow! 60 threads. This must be a record.

I'm keeping an eye on it but will probably not comment much until the appeal. Hopefully I can do live pasting then.

And for nauticant's sanity, maybe a new thread chain can be started for that, or other people do thread changes as they approach.

With reference to a GRC given to a trans man trying to become pregnant, I thought I had seen that legally only a mother can give birth and it registered on the birth certificate. I thought they tried to get it registered that a father had given birth but it was refused. If so how does that work for a pregnant trans man with a GRC at the time of birth?

You are correct. Freddie McConnell has a GRC so this has been tested and a judgement stands.

As to the Lay Members - a friend in our group has confirmed

"The only information that HMCTS can provide in relation to lay panel members is what’s published in the judgment"

So no full names forthcoming. Interesting the HM Courts and Tribunal Services are so keen to keep lay members names so hidden even for the purposes of a complaint.

Presumably the info may be available to the legal teams? Otherwise they couldn't research and request recusals unless panel members volunteered potential CoIs?

MyrtleLion · 17/12/2025 16:49

And they were all started by Gasp0deTheW0nderD0g?

Wow.

The legal team only have what observers have…..

however Scotland seems like a particularly closed shop
