Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton, following Employment Tribunal judgment - thread #60

1000 replies

nauticant · 16/12/2025 22:37

Judgment was handed down on 8 December 2025:

https://assets.publishing.service.gov.uk/media/6936ce28a6fc97b81e57436a/S_Peggie_v_Fife_Health_Board__Dr_Upton.pdf

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.
Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal.

The hearing was live tweeted by x.com/tribunaltweets and there's additional information here: tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-005 and tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-bd6.

Upton took up my headspace today.

We know that he got married soon before he had lady feelings.

So heterosexual marriage.

He didn’t have a GRC. but if he were to apply then:

If you’re currently married or in a civil partnership

When you apply for a certificate, if you want to stay married or in a civil partnership then your partner will need to sign a document to agree to that.

You can still apply even if your partner refuses to sign the document or you want to end your marriage or civil partnership. If your application is successful you’ll get an ‘interim certificate’.

You can only use your interim certificate to end your marriage or civil partnership.

You’ll have 6 months to apply for an annulment, divorce or dissolution from when you get your interim certificate.

You can get a full certificate once you’re no longer married or in a civil partnership.

He either got married knowing he was a biological woman so falsified his marriage or he transformed into a biological woman by the power of self ID over a few months.

And his wife is now in a lesbian marriage.

Actual bonkers.

I still shudder when I visualise those pink leggings... That photographer was a genius and aptly gave a visual representation of the issues facing us with this nonsense. It also resulted in "rapist gender". Despite being an unwelcome visual for me, it managed to bring down the odious Nicola sturgeon, and for that, I am grateful.

"isla bryson" chose to wear those leggings precisely to say 'fuck you' to all women, including the one who died on his tiny hill.

Jumping back, our version of pax, trucie etc was "Keys!" with both thumbs up. I've never heard of any of the others before this thread.

I wonder how many other people's headspace Dr U has invaded?

There was a study done in the 1950s by Iona and Peter Opie of all sorts of different regional variations of kids' games and terminology etc, which was published as The Lore and Language of Schoolchildren. I can't lay my hands on my copy at the moment, but one of the things in that is a map of the distribution of different "truce" terms across the country. I grew up in an area that used "vainites" instead, although we did use jinx for the "both saying the same thing at the same time" thing.

I loved The Lore and Language of Schoolchildren. My dad, who was a doctor, was randomly given a copy as a gift by a patient. He never read it, but I, aged ten, did.

Thank you for all the alternatives to our 'Pax', I'm keeping a note of them and I'll post a listSmile
A vague theory is forming in my mind about them being mis-pronunciations of Latin or French or something. And the crossed fingers is clearly religious.
But thumbs up and 'Barley'.... well, 'parley' is a discussion to arrange a truce..
I wonder am I going down the wrong rabbit-hole. But it's fun anywaySmile

edited to say thank you for the Opie tip!

We had Barley in 1980s Brum.

weegielass · 17/12/2025 18:22

for @nauticant's sanity we should maybe campaign for threads to be never ending, rather than ending at 1000 posts!

He absolutely did. But did you notice that most newspapers and online news websites used a cropped version of the photo? Most of them were of just his face, or were cropped to above dick level.

North American here - we had “Uncle!” where you have “pax,” but I feel it was used slightly differently. It had more of a sense of “I give up, stop, you’re hurting me” and bullies would in fact state that they were going to make someone say “uncle,” or joke that so-and-so was such a baby that they always said uncle. “Are you gonna say uncle, you wuss?” etc.

The Telegraph gave us the full image. I was particularly struck by the small snail that had crept into his crotch to keep warm and damp.

peakedtraybake · 17/12/2025 18:57

Our "pax" was faynights (never saw it written so no idea of spelling!)

Re TIFs being mothers/the McConnell case, I find it pleasing that this means that mother is, in law, a gender neutral but sex realist word.

The issues identified by the Commissioner which the intervention will seek to resolve include:

  • Concerns around NHS Fife’s interpretation of FOI requests
  • Concerns around the appropriate identification of information covered by requests
  • Concerns around the handling of requests relating to high profile issues
  • Concerns around the handling of requests involving personal data
  • Concerns around NHS Fife’s co-operation with the Commissioner’s staff during the investigatory process
  • Concerns around NHS Fife’s governance of its FOI function.

Dear Carol, so kind. Such a good friend.

“ a dispute that ultimately changed lives and communities forever.”

Concerns around NHS Fife’s co-operation with the Commissioner’s staff during the investigatory process

So they did not comply with the ICO's request any more than they complied with Sandie Peggie's legal team's request for disclosure.

What would happen if the Commissioner found the missing "Re:" starting email?

MyThreeWords · 17/12/2025 19:31

The barley/parlay hypothesis sounds very plausible.

On the last thread I mentioned Scribsies as an equivalent of Pax. I'd like to withdraw that: It was actually Scribs that we said. Scribsies must have been something said a town or two away from us.
We had cousins who said fayknights, same as a PP.

RE: renaming of the Big Sond, I think that Kemp should henceforth be known as Unkempt, since he has dismantled the image of himself that we naively had.

And this is what TRSOH describe as the "spousal veto" - that you, MOST unfairly, cannot force your spouse into a same-sex marriage: if you transition, they must have a way out before it can be official. Yet another example of twisting language for political ends.

Well, there's certainly something about Fife Cooncil and certain Fife businesses.

The article references Seafield Colliery. There's now a private housing estate there. For some reason, the houses were all - to my knowledge - purchased by incomers from Edinburgh and other areas.

All the necessary permissions for building were given. Nevertheless, for some strange reason the locals weren't so keen on buying houses on top of checks notes a coal mine known to be particularly prone to flooding. You'd think that the name might have given it away, wouldn't you? (The estate is called Seafield. The developers reckon that the view is 'stunning'.)
