This may be a simplistic way of looking at it but no doubt this story will be all over the media tonight. Would they be allowed to name the panel member in question and, if so, what are the chances of other, more recent activity in support of TRA groups coming to light?

One of the panel members was a director of a women's organisation that supported TWAW. Didn't remove herself. Judge may have known and should have stopped hearing if so. Naomi asking for whole panel to be removed and the case heard again with a new panel.

DB has done a lot of things in the intervening years, it wouldn't surprise me at all if she doesn't remember that the EWN was part of a consortium of something elses that was under the umbrella of something else that turned out to be captured..
I'm not buying this line .. I hope NC proves me wrong, as she always does if I doubt herSmile

Not sure the daughter is the person you are looking at @anyolddinosaur - they seem to be a beautician but there is someone of the same name who does PR and marketing for Re3 - more likely to be them?

If she’s been a panel member for 20 years that dates back to the time of her departure from the board of EWN. She may have spent the last 20 years being scrupulously careful what causes she supports. A lack of social media profile can also be an indication of a righteous determination not to prejudice her impartiality. Most judges don’t tweet, either.

A social media profile will be held against you, one way or another. It would be ironic if the lack of a social media profile was, too.

Not particularly, just to be alive to the fact that it's a small and insular place and lots of these connections exist. I've done recruitments in NI where you have to ask the panel if they know any of the candidates, and the usual answer is "oh yeah, we know all these people". Which is not usually a problem as long as everything is declared.

One of the biggest NI tribunal cases I can remember was Lennon v DRD, where they got a Stormont minister under oath claiming that he didn't know a very prominent individual who lived in his constituency. The tribunal did not find this convincing.

My understanding for these panels is that you have not only to be unbiased, but be seen to be unbiased. Therefore if you are presented with a tribunal where person X has spoken about group Y, and your granny’s cleaner’s nephew is a member of group Y, you have to say so, so that the parties involved can decide if they would prefer you not to be involved. You may have no involvement with Y, but you have to declare your possible connection - it’s up to the claimant and respondent to decide if your connection is relevant or not. Not you.

I agree it could all be as flimsy as R’s barrister says. But it’s the failure to declare the flimsy association to get it out the way & ensure everyone can be satisfied there’s no concern over any degree of bias. If it’s as flimsy as claimed, it would not have derailed the case & would have been quickly dealt with, had it been declared at the start. Why she’s failed to declare it may be entirely innocent. But it’s created this massive problem & potentially tanked a whole tribunal in the process.

No, Belfast Telegraph article from 2010 (when it was Not Really A Thing) says: Debbie Boyd (50) is the chief executive officer of Re3, a resource and recycling company. She lives in Armagh with husband Trevor and daughter Zoe (22).

But NC is not using it on its own and she made clear at the start it is not damning in and of itself but that the facial expressions and behaviour denote an active bias which in combination with the fact she has not declared historic connections which PB should have known to do, particularly when it seems to be referenced on her ET page (although I might have misunderstood that as it’s moving so fast) adds up to grounds for a recusal. Cumulative.

i also don't buy that PB could have forgotten. I think any ET panel member will be canvassed prior to their appointment on all
appointments last or present that might interact with the case. I don’t think that because it is historical that’s a get out of jail free card so to speak. If she has forgotten she should say so.

I think NC does know that PB is biased, has known that from the start but has had nothing to establish it and is increasingly aware that the J, from the off, has favoured PBs position. I think NC has been SICK OF THIS SHIT from the off which is why she did not even seem to show any slight sense of being nicey nicey to the panel.
