Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The hearing started on October 20th, with evidence now complete. Submissions are being made on November 11th. To view the hearing online requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. An alternative to X is to use Nitter: nitter.net/tribunaltweets or nitter.poast.org/tribunaltweets

The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

The judgement is 134 pages long so we are taking our time to go through it properly.
It was produced after a 16-day tribunal held in Newcastle in October and November last year which heard from 24 witnesses also took into account some 4,500 pages of documentation.

One is claiming the tribunal stated "the claimants needed "to be educated on trans rights and to broaden their mindsets". Not sure where they get that from. Mind you, they're also advocating for "bigot-only changing rooms" Grin

I suspect the claim against "Rose" has been dismissed is because it could be seen that he was doing what his employer said he could do. The blame then sits with the employer (which is what's been found).

Agree with this. The trust told him to undress in there so he did. And the fact the poor nurse complained about him asking her if she was getting changed, and the trust still did nothing is absolutely sickening.

These judgements never seem to find the man who says he's a woman guilty of anything harassment / voyeurism- agree with posters above it's hard to prove motive. And they all so far have had permission from the employer, so it's right the employer gets hammered and a grey area with the bloke doing it.

Personally I think we need a law change stating that ANY bloke- whatever his inner gender beliefs or GRC status- who enters a female space is guilty of crime eg harassment/ voyeurism against women.

So then individual behaviour/ male contempt for female privacy-as well as the employer's- can then be addressed. (With only certain exceptions- a male cleaner, emergency personnel attending a female patient etc).

Exactly, the motivation for using the wrong changing room is irrelevant, the same as it is for a male in women's sports etc etc. It does not matter if they are a pervert, a cheat, or suffer from genuine dysphoria and absolutely believe themselves to be female. They should not be in those spaces. It may alter the level of sympathy I have for the person, but it does not change the fundamental principle that they should not be there.

Yes - there was that case that the NHS lost at first tribunal (and didn't appeal) of the chap parading his privates through the changing room and - got compensation coz he was a 'woman' and it wouldn't matter if any 'other' women did it. Impossible to prove motivation.

Employers now have nowhere to hide on this one (based on the headlines at least). If they tell a male that he can use a female changing room it is likely to be indirect sex discrimination.

I hear the sound of lots of policies being quickly ripped up.

If an employer has wrongly told a male that he can use the female changing room I would say up until now he would not be at fault legally (rather the employer would be). I am not so sure that will be as protective from now on given the publicity about this case. If as an employee your employer instructs you to do something that you know to be unlawful it’s a much greyer area.

More pressure on Philipson to publish the guidance.
