NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #50

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It will resume again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

For which I do not blame him one little bit! He must've known there was going to be some kind of nonsense before the submissions were allowed to proceed.

Reacting his name undermines the fact he is a man, which is crucial to the case. So I'd say no to that. Even Dr Upton, which is neutral, does that.

Ms Cunningham says it is an identifying fact that Dr Upton is a man, and it is obvious to those who meet the medic.
Ms Russell is back up. She's talking about the equal treatment benchmark and Dr Upton's right to privacy and a fair trial. Therefore, she says her argument is not futile.
She wants employment judge Sandy Kemp to make an order restricting the dead name being published.

In the argument over the use of Dr Upton's former name, Ms Cunningham refers to the Streisand effect.
This is when an attempt to suppress or hide information backfires and ends up drawing much more attention to it.
It’s named after the singer Barbra Streisand, who in 2003 tried to sue a photographer to remove an aerial photo of her Malibu home from a public collection documenting coastal erosion.
Before the lawsuit, the photo had been downloaded only a handful of times. After news of the lawsuit spread, the image was viewed hundreds of thousands of times.

Jane Russell is talking about dead naming, that is referring to a transgender person by the name they used before they identified as their acquired gender.

Although I could access the hearing using my iPad in February, in July it worked neither on my iPad nor my iPhone. I tried 3 different browsers on my iPad.

Now I only try on the desktop. Have you tried using the laptop, as you did before?

Same for me. In February I could use Safari on my both my iPhone & my MacBook to view the proceedings. Last July it only worked with Chrome on my MacBook. This morning it’s not working on my iPhone with Safari or Chrome. Hopefully it will still be OK with Chrome on my MacBook when I am able to settle down with that.

Interesting article and depressing in that this informed and thoughtful evaluation is not commonly held by psychologists.

To add to the list, I worked in Madagascar where suicide had been almost completely unheard of because of traditions worshipping ancestors. Then French daytime soap operas were introduced as a tv programme with suicide storylines and all of sudden rates of suicide began to climb. Introduce an idea where it’s not existed before and it can spread like wildfire.

I am horrified by this silencing of reality- Sandie objected to a 6ft bloke in the female changing rooms, and now the judge has ruled her submissions must be falsified to suit his fantasy. It is so offensive to me as a woman.
