NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

JR Why mention the BMA?
MC They'd been v helpful what is and isnt the right process re drs struggling for a huge range of issues. Hold a lot of knowledge and a resource I've used before.
JR U say similar to a patient being abusive
MC Yes, my understanding that behav based on
a PC cld be a HC. And DU has a PC.
JR Why do u think u were informed of the incident by KS?
MC As I'm an ED consultant. I'm one of the older consultants and ppl think I've experienced things others havent. Plus I'm dep clinical lead

Interesting. Do you think other trusts watching will be silently concluding that employing trans people may be expensive?

I met up with my partner's niece who's in high-level recruitment a few weeks ago and she indicated that she'd had discreet conversations with people from a couple of big multinational names in which she was asked to remove any candidates who had a history of championing gender or were themselves trans.

Then that's illegal.

JR How were interests between SP and DU balanced?
MC [pause] An email chain among the ED consultant team. The mgmt process betwn drs and nurses is v separate which is my prev experience w/in the NHS. V little involvement in mgmt between the two

JR trying to defend why nobody have a damn about SP - not MC's job as SP not a doc.

MC Senior nursing team wld contact SP and we'd focus on the medical team, which is what I'd expect
JR What about the seriousness?
MC Very serious. Because the events described suggest a v unpleasant convo and interactions of this type have potential to make v challenging

so frustrating - especially in this medical setting.

Surely "believing humans can't change sex" is fairly standard, apart from the willfully self deluded.

I wonder if NC will address this in her cross?
or it is the elephant in the courtroom everyone is dancing around & pretending they can't see

DU - need to communicate and respect eachother you don't have to like eachother. A+E is a team game. You have to be able to trust the team as things can

MC Before interview. We had a brief convo and asked if was aware was trans. I answered I had wondered.

Hang on. Isn't that literal violence?? Why isn't MC in the dock? Did DU run out crying when MC made that comment?
