NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Idk, if I find something that’s technically inexplicable, I might use one or even two.

I’d be willing to bet that if he had worked pro bono she’d have claimed he’d have only done that if he was biased, had skin in the game somehow. 😂

It’s desperate stuff. The Judge and panel will understand these people are paid (it’s their job), so I assume it’s to play to those who want to believe it’s unfair. Hard to believe the msm would pay any heed to it.

That's true. For £2000 a day (or was it per hour?) I'd make myself a little foolish if I had to.

I don't know what sanctions might be available in a civil case but in a criminal case they are severe.

I personally know of one where the accused had attempted to cover up the crime they were charged with by tampering with 'contemporaneous notes' of the incident in question. The trial was stopped when this became apparent.
The evidence of the crime was all a bit hazy and the original charge was dropped.

However the accused was subsequently charged and convicted of perverting the course of justice and was sentenced to a term of imprisonment.

I don't know what might happen here but generally the courts take an extremely dim view of evidence tampering.

I'm trying to work and follow, but I've spent a lot of time in criminal court and working on criminal cases but only been involved in a few ET cases via the HSE....

BUT can I just say what a ABSOLUTE breath of fresh air it is to have a competent grown up giving evidence in this case.

Think JR should have quit while she was ahead..instead of constantly drawing attention to the possibility Upton has lied. Because with every time she mentions this, he gets another opportunity to explain that it just couldn't have happened any other way.

It makes no sense though. Someone who is willing to do it for free is much more likely to be there because they have an agenda. Someone paid is just doing it because they're paid. I understand the implication is that he's being paid to give a particular view but I just don't think the logic stands up and little irritates me more than poor logic.

And why is that? Because I know in that situation I would not dare to try to manipulate evidence. I wonder what it says about his character that he did? No, I'm being unnecessarily coy, I know exactly what it says about his character that he did; not only is he not trustworthy, at any point in time he thinks he is the cleverest and most important person in the room. So he was always going to be easily busted.

Its shows that he is exactly what we can all see he is, a narcissist for whom transgression into female spaces for his own validatory feelings are all, even at the expense of torpedoing a fledgling career in medicine that he presumably worked very hard for. Captured by his fetish.
