NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

But her witness said he believed Dr U and she was fine with that and that was opinion based!

The arrogance of a junior doctor thinking he could hide evidence collected by Google, a massiveely parallel always on sync engine. INCREDIBLE

Yes, the evidence is the evidence. That’s all that matters.

ONLY experts are allowed to provide an opinion. No other witnesses are. Including the Fife IT guy who is not an expert in this case.

And why is that? Because I know in that situation I would not dare to try to manipulate evidence. I wonder what it says about his character that he did? No, I'm being unnecessarily coy, I know exactly what it says about his character that he did; not only is he not trustworthy, at any point in time he thinks he is the cleverest and most important person in the room. So he was always going to be easily busted.

And this is really important. Sandie may only be getting the justice she deserves because she has a backer with VERY deep pockets.
MG, NC and CE will have been told to do whatever it takes, money no issue.
Without this Sandie could have been under the bus.

But she stood up for herself and for the women of Scotland and she found herself the A Team!

I mean, to be fair, JR is doing her best to defend her client. It does look desperate and mean but if she can put doubt in the panel's mind about the credibility of the expert witness then her job is done. I doubt this will do that, however.

I'd be more concerned if he was doing it for free to be honest.

Even if JB’s evidence is thrown out it is all over social media that Upton’s notes are not contemporaneous and that he is an individual that you trust at your own peril.

I think the exclamation marks are shorthand for JB thinks DU's dates are bullshit and he has been fiddling with the notes.

I think this nails it. KS and all the other 'yes' girls are just bit players in DU's narcissistic I Am The Most Important Woman narrative.

They always point this out with experts and she has the advantage of her expert being a fife guy so technically not paid..
