NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

nauticant · 25/07/2025 10:54

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

There I was thinking this part of the case was going to be dull.

JR sounds to me like someone who is very cross indeed but trying to sound calm and reasonable.

Or someone who is trying to sound reasonable but with a decided undertone of threat.

Later - great interruption by CE (?) asking if JR implying professional misconduct?

Great comeback later by the witness, about whether he is being paid.

I imagine that this is doing nothing to help the case with the J and panel, but may provide something for DU's supporters to write about on SM.

Question for lawyers - I thought expert witnesses were supposed to be unbiased?

Isn't this a serious allegation?

MarieDeGournay · 25/07/2025 12:39

B - i will be paid yes
JR - who will you invoice
JB - instructor
JR - skilled witness?
JB - yes JR - duty to be impartial
JB - yes
JR - second sentance 1695 para 3.6 In the first instance I'm at a total loss, ends with an !

Use of ! means not impartial??

eatfigs · 25/07/2025 12:37

"You were paid for report, not pro bono."

"Yes, I will be paid, as you will be."

Haha. He's not taking any of her shite!

Brilliant, this guy is just perfect. And if that is what JR is stooping to then she clearly has nothing real to use. And that will be obvious to the J.

FeedbackProvider · 25/07/2025 12:39

Insinuating about the financial relationship of the claimant and skilled witness is a losing strategy. And now she’s tone policing some evidence. Exclamation marks of all things! Weak sauce.

chilling19 · 25/07/2025 12:39

Classic - you are a gun for hire from JR. Surprised she didn’t ask how much.

MyAmpleSheep · 25/07/2025 12:39

MummBRaaarrrTheEverLeaking · 25/07/2025 12:39

I think we should rename today Jimday 🎉

AMillionMugsNoTeabags · 25/07/2025 12:39

What are the rules on experts providing opinion? Surely they’re allowed to?

Mmmnotsure · 25/07/2025 12:40

JR has to discredit this witness as it’s all she has.

Lunde · 25/07/2025 12:40

GreenFriedTomato · 25/07/2025 12:19

He's very clear. Saying none of these possible explanations given by Upton/Fife IT are possible. No technical explanations.

He ho, hey ho, up the garden path we go 🎵🎶🎵🎶

Trouble is Fife are on the primrose path 🌸

(primrose path the pursuit of pleasure, especially when it is seen to bring disastrous consequences - from Hamlet.)

MarieDeGournay · 25/07/2025 12:40

JR - 3rd sent. Once again, describe being perplexed and another ! at the end
JB - yes
JR - opinion?
JB - yes

'Not one, but TWO exclamation marks! This witness is clearly biased. I rest my case'.

HoolitThatFuse · 25/07/2025 12:41

JB no aboot tae keech himsel under pressure.

NebulousSupportPostcard · 25/07/2025 12:41

JR seems to have nothing else but to attack the credibility of the witness based on the frankness and working-class-ness of his report. He used exclamation marks and expressed opinions.

MarieDeGournay · 25/07/2025 12:41

Lunde · 25/07/2025 12:40

'Primrose path to th'everlasting bonfire' - from 'The [other] Scottish Tragedy', from memory?

LadyBracknellsHandbagg · 25/07/2025 12:41

JR has lost the bloody plot, what an absolute disgrace she is.

Jitrenka · 25/07/2025 12:42

JR is actually insane 🤦‍♀️

maltravers · 25/07/2025 12:42

“Yes, I will be paid, as you will” - touché.

Instructions · 25/07/2025 12:42

Hang on, JR is reduced to whining about punctuation? Oh my goodness. This must be professionally humiliating.
