NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #34

1000 replies

nauticant · 21/07/2025 09:18

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

JR You didnt take much account of Miss Gribbon's email. Take a look at it now please. What was yr awareness of these issues raised

'Miss Gribbons' = SP's solicitor, this must be a ref to the first representation on behalf of SP?

So have I got this right, no reference to the NHSF statements at all?

MarieDeGournay · 21/07/2025 11:20

CM I became aware of SP as asked to do a Sx review. Was verbal request to do a Sx review, and agreed to meet SP after brief doc review.
JR Look at doc on p298, email 22 Feb re being allocated.
CM GM requested I did the review.

No idea what a Sx review is - ??

Just curious to know the age span of posters on here.
I’m 77

You never ask a laydeee* her age! I am as old as my tongue but a little older than my teeth.

*<has quick chromosome check> - XX ... yes, I'm a fully adult female.

Camping where? August is a very unreliable month weather-wise. Can be searing heat in the daytime, freezing at night with frost on the sleeping bag, or unremitting downpours with wind and hail.

I'd wait til September and just go for the weekend.

Dorset.

I know, August is not the best. 😞 I well remember our last family camping holiday when the kids were teens. On the last night two of them abandoned the tent and slept in the car. But we oldies survived a borrowed tent for a couple of nights last August, so fingers crossed.

No, guess that's why they started late though

jonathangb · 21/07/2025 11:21

They must persevere to the bitter end in order to get a decision is how I see it. Then if it goes against NHS Fife they might appeal. As I understand it, this Tribunal counts as 'Lower level' and decision will not be a precedent. That would have to come from a higher tier Tribunal.
Is it ridiculous to suggest that Scottish Gov might even somehow join in that action to force a decision. They have been so invested in this for years. Credibility? They can't just let go and let it fizzle out. Can they?
"Canons to the left of them, canons to the right but onward".
This could take longer than building a small ship.

A little older than Sandie and add avocado to potato salad.

I didn’t join FWR for the cake recipes, but they were an added benefit at one time.
