NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

I feel like I've heard quite enough to know that the investigation leading to the suspension of Sandie was not done properly!!!!

So Dr Upton not being questioned until next week on Monday! Bugger!

That email that NC said she'd been helpfully reminded of, that said Esther wouldn't lead investigation because she needed to be a witness in it - that was not an email within Fife, is that right, but an email to NC or someone on her team, i.e. in the runup to this case?

Does that include not reading social media/online commentary? It does for jurors, is this different?

The judge will be irritated but not totally surprised. Document disclosure cock ups are not unusual.

However, it calls into question the level of organisation and rigour in Fife’s processes even if the docs disclosed prove to be benign. If the docs are not benign and they may be considered prejudicial to Fife then I expect a significant sense of humour failure by the judge.

I imagine Dr U would prefer to get his cross X over with today rather than have the whole weekend anticipating it.

Just as a random aside on watching the live feed - why is it that so many men think growing their hair is enough to look female? It's not. Have they never heard of Jon Bon Jovi etc? At one point most male pop stars had long hair. Doesn't make you a woman!

Im interested in that note that said she needed to be unsuspended and go back to work. I was rolling pizza dough at the time so multitasking, but surely this proves that there had already been an investigation?

Another one here disappointed about cross-examination being deferred till Monday. I had set Friday afternoon aside for some enjoyable entertainment to wind down at the end of the week. But Monday is unavoidably a work day.

The judge will certainly be irritated and quite possibly annoyed. Given that these are emotions, yes the judge will be emotional . However, if you mean will the judge be upset, probably not. He will almost certainly have seen it all before. It is amazing the number of people who think they can hide inconvenient evidence from the courts by failing to disclose documents that are clearly relevant.

Unless she receives 15,000 emails at 10pm on Sunday night...

Really clever to ask that the IT department perform a search using defined search terms. Cuts out individuals thinking they have to make a decision and cannot be impartial (either knowingly or not).
