nauticant · 04/02/2025 11:37

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

They'll be restricting our access now

As noted upthread most of us women have taken great pains to ensure we don't disrupt. There's only one side that benefits from a failure of open justice in this case. Just saying. I hope the Judge is intelligent enough to see this.

Ereshkigalangcleg · 04/02/2025 14:51

Yes the clerk has definitely gone through and turned everyone's mics off.

Datun · 04/02/2025 14:51

There will be loads of TRA's trying to stop people watching this.

Signalbox · 04/02/2025 14:50

Wtf. That must have been deliberate. Trying to sabotage us being allowed to watch. I’m kicked out again now 😠

I think Hanlon's razor applies

Ereshkigalangcleg · 04/02/2025 14:51

In past hearings I mean.

Can't they just mute everybody, all at once? You'd think in this day and age...😄

It's not just about muting though. We had video of the person drying their hair

TWETMIRF · 04/02/2025 14:51

I'm watching on my phone so couldn't see anything other the tribunal room

Signalbox · 04/02/2025 14:51

seXX · 04/02/2025 14:51

it looked very set up, especially as the person had dry hair!

It looked really set up.

Rightsraptor · 04/02/2025 14:51

The hair looked suspiciously like a wig

Yes.

I'm on my phone and I saw it

🤣🤣

Cross posted! Yep.

Because this ideology does not bear scrutiny, particularly in a setting where witnesses are supposed to tell the truth as THEY see it.

That's a distinct possibility.

ILikeDungs · 04/02/2025 14:53

I saw it, and the person then looked right at the screen, and then resumed 'drying' hair

ItsAllGoingToBeFine · 04/02/2025 14:53

I feel sorry for the clerk though - I bet they are getting their arse kicked and they will be getting the blame

legalimmigrant · 04/02/2025 14:53

Rightsraptor · 04/02/2025 14:51

Yes. I agree. Also looked dry. Looked like a deliberate sabotage attempt to me.

It's not bloody rocket science to only give out observer access to people observing.

Deliberate disruption is surely risking contempt of court?

ChimpanzeeThatMonkeyNews · 04/02/2025 14:53

Yeah, me too.

Signalbox · 04/02/2025 14:54

I think this will be the excuse they need to ban the public. They should automatically mute people on entry. It’s so obvious.

Not traceable though

ChimpanzeeThatMonkeyNews · 04/02/2025 14:54

Poor Sandie. She can do without this.

GCITC · 04/02/2025 14:54

I think a big problem is that Clerks are running multiple cases/rooms at once, and so they can't be constantly monitoring the feed.

Saying that this is the first case I've attended where observers have not been mutend en masse, which would have solved a lot of this afternoons interruptions.

Still in lobby

INAL but isn't SP being asked an awful lot of questions about other people's feelings, actions and motivations? How can she know them?

Also JR appears (to my uneducated ear) to be asking lots of leading questions.

Sorry for the late response - only just catching up on this thread. Leading questions are allowed in cross examination but not in direct examination. So JR cannot ask any leading questions of DU, for example, but she can ask as many leading questions of SP as she wants..
