The linked article quotes Sam's non binary status, which he's been very vocal about. Sam has been very clear that his non binary personality is an important part of his identity.

Oh and men stealing women's clothing is a well known indicator of what is socially considered deviant behaviour. Women stealing is usually rooted in different causes.

There's nothing gender diverse about creepy men stealing women's clothes. It's rather typical male-pattern sexually-motivated criminal behaviour. He's a Benny Hill character, not the Che Guevara of diversity. Maybe his non-binary-ness made him too ladylike to clamber over a garden fence in the middle of the night so he went for the more brazen airport carousel option? Who knows?

The guy was in a very important position on a good wage. If he wanted to buy the clothes from a shop he could afford it easily. But he wanted to take the clothes and luggage belonging to a woman. He's done it more than once.
It's a fetish. Like the other fetishes he's put on display, only this one is illegal and non consentual.
He's a thief of women's underwear. It is not unreasonable to suspect he gets sexual gratification from it.
We'll know more after the trial. The jury are the finders of fact.

Ignoring the derailer, the simplest way for the judicial system to cope with where to confine an enbie within a binary prison system, is to confine them in the prison for others of their sex. The alternative - which I expect will happen - is to avoid the issue entirely by suspending the sentence.

I'm never sure why this particular aspect (non binary) of his/their identity needs mentioning. The theft was still a horrible crime. Do they mention other parts of his/ their identity? If not, why not?

To be fair, the article felt the need to mention one aspect of his identity and that's not unusual nowadays given odd privileging of the reporting of gender identity for those people who actually have them. No one would bother to report that I was agender if I nicked something. The issue is not the OPs

I have no idea if there's a section of MN where sexual orientation is the topic at hand (there must be, but I've never looked for it). It probably wouldn't be totally odd to see a post with a title like that over there. Context is everything.

This guy has stolen a few suitcases. The first time he was caught, it was brushed off. After the third, they arrested him and fired him. His being non-binary is a big part of this since the Non-binaries were so proud to have him as a representative but now that's gone south. Well off man going around stealing women's luggage seems like some sort of mental illness or fetish.

It is currently not factual to categorically state that prisons are segregated by sex not identity.

Men's prisons are mostly single sex. Women's are more of a melting pot- neither single sex nor single gender.

Prisons are intended to be segregated by sex. You are correct, there are the women who identify as men, who are mostly imprisoned with women. But there are also men who identify as women, who can also be found in women's prisons. This is now common knowledge after the recent reverse ferret of the Scottish prison service which has resulted in men already in women's prisons staying there but they made quite a splash about not accepting new ones by default.
But you already know this, so you've been waiting for someone to point out the obvious so you could play a "gotcha". Please do tell.
