In person appeal court hearing starts at 11.30. Updates to follow this afternoon.

That sounds ro me like there won't be any live tweeting, but an update from fpfw afterwards on how it went.

What gave you that impression?

The interventions by the judges, the muddled arguments, saying sex & gender when meaning sex & gender reassignment. FPFW QC admired towards the end of his part that he'd veered away from what was supposed to be a straightforward point & would reflect/answer Qs on the written submission instead (hoping the judges have read them).

There might be lots of technical legal arguments in the bundle but it was quite incoherent at times, he lost his thread a bit from the number of interventions from judges.

My expectation is this will fail, unless he writes his arguments better than he made them in person.

To be fair, it's not the original QC involved, he's likely picked this up with v little time to get fully to grips with what's a complex & confusing issue even for hardened terven women. But it just didn't sound good at all.

Oh dear. It must be really hard picking it up. From following lots of these cases it seems they always suffer from muddling concepts. Judges muddle and blur things. Usually the opponents try and blur & fudge together things or over complicate things. So it's not good if our 'side' is not setting things out clear & precise either.

He steadied himself for the short conclusion after lunch & made specific points. Sounded better. Now Scotgov up - not overly impressed with his arguments either!

It'll be the technical arguments that'll swing it either way, so it's maybe not as bad as the morning session might have indicated. But it's a fraught & complicated subject & as IANAL I could be way off the mark on my impressions.

If it's any consolation, Scotgov QC now sounding as incoherent as keeps conflating sex & gender in what he's trying to argue.

Good luck to the judges trying to unravel what actual point anyone has actually made cos sex & gender keeps getting muddled, accidentally & deliberately, depending on the point being made.

There's some seriously dodgy arguments been made (intersex - being born with no sex, or characteristics of both sexes - seriously? 😒) but there is some coherent ones getting made now.
