Do you get transitional protection as part of your claim? You usually get that if you moved from Tax Credits or maybe some others too. Any back pay is taken pound for pound from the transitional protection. For example, if you have £300 a month transitional protection and your back pay is £200, you won't receive any back pay at all and your transitional protection will reduce to £100.

Can you please explain what this means to me please? So I apply for the back payment from UC they will take money from it because I got the transitional protection? I don’t understand

Me too - such an awful thought tbh. But I had to go to tribunal for one of my other children so it’s a real possibility for us I guess. At least you get paid back to the date you claimed…

We were awarded last year for HRC and LRM but trying to fight for the HRM due to her being a risk out in public , no danger awareness and needs to be restrained on a daily basis. So even if we have to go through tribunal it is what it is but I’m going to carry on fighting as I know what she’s entitled to x

GiGiW4 · 19/05/2025 16:20

Yes that's right. It won't affect a back payment from DLA, but if you are due a back payment from UC they will deduct it from the transitional protection first pound for pound.
