My guess is that he says either that he has £1 left or that he's running at a deficit.

If they spent 1/2 the effort on their marriages that they expended in avoiding parental and marital responsibilities the divorce rate would be practically 0%

@AcrossthePond55 - sadly for him he is unable to dispute his income or his outgoings as I have sight of both of them. One of the disadvantages of leaving all that tedious financial admin to your wife Grin.

So no, he’s not even arguing that he can’t afford spousal support. His exact words are that I’m not destitute because I can cash in my pension. So he shouldn’t have to pay anything.

If he has £5,500 a month coming in after tax he's on over £90k a year! Maybe not enough for him to pay spousal, but certainly enough to really help out if he pays his CMS.

YY that’s £5,500 disposable income. A mere 262 times my monthly disposable income on which I’ve to keep 3 Teens.

Or to put it another way, he has 99.6% of our joint income and I and the kids have 0.4%.

He says he has taken legal advice Hmm. I wonder where he has found a solicitor who is prepared to stand up in court and argue this.

@pointythings oh no my dear you are forgetting his large pension contribution. That’s AFTER his pension.

And yes it’s plenty for spousal support pre divorce , because of the disparity in our incomes.

Somehow he has got in in his head that he doesn't have to pay anything until the kids and I are , in his words, “ destitute” . Which is quite a statement for a man who earns good money and has a maxed out pension.

I feel sad that I had kids with him and I hope they never have to find out what he’s really like.

YY @RandomMess I won’t get spousal after the divorce only before. But I have an excellent case for more than 50% of assets.

I can’t believe that he actually put in writing that he won’t support his kids until they are destitute. He’s disgusting.

Oh, the court process is going to be painful for him! You're allowed to be angry about this - in fact angry is good - but you're in this for the long game, which is you getting a fair payout and fair maintenance. Hang in there!
