I think that parking act was put into place to stop cowboy clamping. It used to happen a fair bit, people would park on what they understood to be legitimate parking areas, there would be either no sign at all or a tiny sign hidden away somewhere that nobody would see it, and they’d get back after a short amount of time to find themselves clamped and would have scary men demanding large amounts of money to release them.

Howling at owness. Bet you dont get too many clients when they realise you cant possibly be legally trained.

Plus further down the act is a paragraph about barriers being in place, wether open or not. But the implication is that if you see a barrier then you can expect the barrier to be closed.
And that's from memory of reading the act, around 15 years ago.

I'm gutted because I actually have to go to work in the office today, in proper clothes and everything!

I would just keep checking on my phone, but I'll be in a meeting for much of the time and it would be rather rude.

I finish at 2.30 and hope I don't miss too much. If the CF comes back this morning for the car, he could well be over the limit to drive if he's been on the piss with his celebrity mate until the small hours. It would be terribly unfortunate if he got stopped by the Plods on the way home.

And I'm gutted that your wonderful DB won't be there for the denouement. I hope you have a nice but feisty mate who can come and provide moral support, OP.

it is a criminal offence to clamp, tow, block-in or immobilise a vehicle without lawful authority on private land under the Protection of Freedoms Act 2012

I would argue that none of the above actually are what you have done. You have offered to release his car at a mutually convenient time, you cannot risk leaving an unsecured gate and as he has shown he is unreliable you couldn’t guarantee he would close the gate after himself.

Also if the onus (owness? Even autocorrect doesn't like that) is not on the driver then the cctv would be perfect evidence for the defendant to prove any alleged damage did not occur, rather than the driver proving it did.

Me too - sat on a train on the way to the office trying to work out how I'll be able to check my phone when in actual face to face meetings.

I would start to get more forceful. You need to tell him.

He did not collect his car at 7.30pm as suggested, and the car is still parked on Private Land, something you instructed him not to do.
The car must be removed at Midday today.

She should give him a very precise time window e.g. 17:07-17:14 and refuse to deal with him outside of that. "Sorry, I've got to go milk the cows now or they're at risk of mastitis. Come back between 07:24 and 07:31 when I should have time for you between mucking out the stables and feeding the chickens".
