Mama1980 · 11/09/2014 13:10

I don't know both lawyers called to judges chambers.

Mama1980 · 11/09/2014 13:14

Meant to write they don't seem to know what's happening, sorry am typing under very wriggly breast feeding baby!

AGnu · 11/09/2014 13:16

They're back with no explanation for the delay... Confused

Was he reasonable? Is the question.

She points out that he ran to the balcony to attract attention, he also made calls, after his shooting, so he was capable of doing all of these things prior to discharging his weapon.

LookingThroughTheFog · 11/09/2014 13:23

It is fine to look at his background to explain his actions - he grew up in a crime ridden area and his mother's paranoia.

She points out that many people are in this position, and that many have been victims but do not act as OP did.

If someone had been looming over him at night, if he'd shot them, that would have been a real emergency, and he could be excused. In this case, he had time to think, reflect, and conduct himself reasonably. A reasonable person, even with his disability, would not have fired four shots into the cubicle.

AGnu · 11/09/2014 13:25

Anyone else want her to stop talking about other scenarios & just get on with it?!

Sounds like she's heading for a culpable homicide verdict but to what extent will she take into account the other factors?

AGnu · 11/09/2014 13:25

So she's saying it's culpable homicide?

The accused new there was a person behind the door, he chose to use the lethal weapon, he was competent and trained. Would a reasonable person have foreseen the reasonable possibility that if he fired shots at the toilet, whoever behind the door might be struck and die as a result.

Would a reasonable person have attempted to guard against that possibility.

Yes to both.

LookingThroughTheFog · 11/09/2014 13:27

He acted too hastily, used excessive force, and was negligent.

Break until tomorrow.

AGnu · 11/09/2014 13:27

He's negligent...

& now they've broken until tomorrow!

bobblewobble · 11/09/2014 13:28

Doesn't that contradict what she said that he wasn't to know he would kill whoever was behind the door?

AGnu · 11/09/2014 13:29

Does seem to bobble! Confused

confusedgirlfromtheShire · 11/09/2014 13:29

Whaaaat? Surely she can only have about 10 minutes left, she was practically there with the conclusions! Why stop until TOMORROW??

msrisotto · 11/09/2014 13:29

Wtf? How long has Court actually been in session today? Hardly a full working day is it.

mumtosome61 · 11/09/2014 13:30

What!! They've spent most of day on break!

Can OP at this point change his plea to guilty of culpable homicide (in light of the fact he looks likely to be found guilty) in order for a reduced sentence, like they do in the US? I'm not sure on South African legalities. If OP could get a reduced sentence, would make sense to admit guilt.

Mama1980 · 11/09/2014 13:31

I'm confused, she said he s negligent but earlier stated that he didn't know/intend to kill whoever was behind the door?

OneStepCloser · 11/09/2014 13:32

Very odd, what a strange place to leave it.
