Can we have the Judge Masipa badge on this thread please, as I've just read that to support her decision she had produced a 10 page typed document overnight. Oh, to be that clever.

I would definitely agree that the report should be confidential. No doubt the conclusions will be presented to the court and therefore us, but I don't think we need to, or should, hear more then that. Everyone should be entitled to patient confidentiality and being a famous person accused of a horrible crime doesn't change that.

I have found the trial fascinating (obviously), but there have been times when it's been uncomfortably voyeristic.

Trials in themselves, shouldn't be punitive, as punishment should only come after the verdict has been reached. That is a human right that everyone should enjoy, again regardless of who they are.

Having your weaknesses and bad experiences detailed and the entire world being privy to that and your reactions to it, seems very close to being punitive.

Plus, there does seem to be a gleeful reaction from certain onlookers at his suffering. Just the fact that he will almost certainly be convicted of a very serious crime and sent to prison isn't enough for them. I doubt hugely that glee comes from any desire to see justice for Reeva Steenkamp, I think it has a rather more base origin then that.

There's also the issue of the trial needing to be televised because, aside from showing OP is getting no preferential treatment, we can't trust our media to report a murder case accurately, which is utterly woeful.

I agree. But I find it really hard not to be voyeristic! It's so fascinating and my own life is so dull!

Yes it is hard for it not to be voyeuristic but (being honest here) my reading genre is crime thrillers, I love films set in Court, and this is all of that with knobs on isn't it..

That is sounding awful, I'm just being truthful and I do try hard to rein it all in at times and remind myself this is real people and a godawful tragedy and sat in that court are people (maybe on both sides) with their hearts breaking. It has opened my eyes to the legal process and how it all works and how time consuming it is, even though it is in SA.

I would agree that there is no need for his whole medical history to be made public, or his personal history except where it is directly relevant.

I was trying to ask about confidentiality at the end of the last thread. If it is correct that OP will be asked a lot of questions about the events of that night, and if, in fact, his version is not really true, then he is bound to slip up at certain points. If it becomes obvious to the psychiatrists that he is lying to them, then how far are they obliged to report that back to the court? What if it becomes clear that he had a very jealous relationship with Reeva or that they argued a great deal - how far is that relevant and how much would have to be reported back? I think the waters could get very muddy.

I also think that if you ask someone about the same thing over and over, then the truth becomes more and more blurred and embellishments are bound to occur whatever.

(I wonder if this is one of the reasons why Roux was opposed to an assessment because he is worried about what OP might say.)

I suppose if he has kept to his story while being cross examined by Nel (Hairy Nel he is called in my family) then being assessed by mental health professionals might be a walk in the park?

It's bizarre that he was not referred for psychiatric evaluation before the trial. And that his interviews with Dr V appear only to have happened recently. Why, other than desperation are the defence bringing this in now? What is the defence? Mistaken for intruder, accident, GAD? It keeps changing...
