Nothing in Boris' message about travel to exchange children for contact.

What is the legal position here?

How could they not even think to include this?

They must have had someone bring it up.

Cafcass have guidance - if it's up to date (hard to tell as I can't see publication dates) then it looks like it is allowed and it does mentions keeping up any routines that are in place for the benefit of the children. I'm sure if you agree between you to keep the kids in one home for the duration that's fine too.

www.cafcass.gov.uk/grown-ups/parents-and-carers/covid-19-guidance-for-children-and-families/

Court hearings will now be remote, if that's useful info fit anyone here.

LittleLittleLittle · 24/03/2020 06:00

@northernlass88 unless one of you are in the group where they have to be shielded, so cannot leave the house, contact carries on as normal.

kc140886 · 24/03/2020 06:23

Did anyone find out the answer to this? Can my son still go to his dads?

Wallywobbles · 24/03/2020 06:33

@Pickles89 DH went to the market yesterday to top up on veg. 10 customers in the huge market so less risky than the supermarket. Markets all closed as of today.

I did one shop last week. Supermarket felt very risky. Shopping trolley handles, loose veg being touched by others. Scales etc. Paid by phone.

4 kids aged 11-15 haven't been outside their homes for 10 days now. Well not quite true we live on a farm absolutely nowhere so they went and played in the river at the bottom of the field yesterday. And they go for a short walk once a day.

We are not allowed more than 1 km from home.

BertieBotts · 24/03/2020 06:34

Yes KC. It's been updated overnight. Travel between parent's houses for under 18s is allowed.

Gove fucking things up

Wait a second ... how do we do custody exchanges?!
Xenia · 24/03/2020 07:59

On which must close the following is useful:-

assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/874732/230320_-Revised_guidance_note-_finalVF.pdf eg garages and vets can open as can hardware shops, launderettes, dry cleaners, post offices, banks, newsagents. If you live at a caravan park as many do you can continue to live there.

Plces of worship can remain open for solitary worship and for live streaming of a service without parishioners there.

The way they have done it is if your business is not on the banned list you can remain open.

Notredamn · 24/03/2020 08:13

Like I spent all night saying.

Happygirl79 · 24/03/2020 08:37

By law its still OK for shared custody of children

Wait a second ... how do we do custody exchanges?!
notthemum · 24/03/2020 08:41

Haven't read the whole thread, but in case you are still wondering, I just checked and government thingy says that
Children below the age of 18 who's parents live in separate houses CAN be transported between the two.

Happygirl79 · 24/03/2020 08:42

Hope that helps. Now just on ITV news that Michael Gove says the opposite. He says now that the children must stay with the parent they are with now until lock down is lifted so who knows
We need clarity.
I think the announcement means only if the child has a medical need.
Lock down roulette is in place

PicsInRed · 24/03/2020 08:43

Notredamn some of us have a court order and a frightening, litigious ex ... so we need clear and explicit instruction if we're to ignore a court order. We need to know we would be backed by the police and the family court. Withholding children from contact is now deemed parental alienation and mothers do have their children removed for this, even where paternal abuse was a factor. We must be so careful and so legally on point.

Given Michael Gove's contradictory statements this morning, it seems the govt actually have no clue what they really want us to do.

They need to issue a clear instruction to both us and the police who will be enforcing this. Othereise, as we've seen here, some will interpret generously, some will interpret literally. This will include police officers, army and family court judges and could result different outcomes for different parents.

It's a bit of a clown show isn't it. 🤡
