@funinthesun19 i put a note on the journal requesting for it to be backdated, that’s just the advice I followed from other people on this thread so I’m not sure whether or not it will automatically get done without requesting it, probably best to be on the safe side xx

they didn’t award me back pay on UC they just added the change and paided me from the date i let them know :(

@Kirst31 I thought it was guaranteed for everyone that they backdate it. Surely they have made a mistake there and should have backdated it for you.

@Kirst31 do you claim carers allowance? The back pay for HRC disabled child element and carers element would be over £2,000 so it’s not right they haven’t gave you that over £369 x

@funinthesun19 i never requested back pay. I just updated my UC then popped a note on my journal saying the only reason I’m just updating is due to DLA’s current wait time and only just finding out. They then wrote a note back to say they’ll send it to a DM to see if I’m eligible for a back pay

At the time it was all being processed (Carers allowance) they just wouldn't pay me for the date of the claim to when i put it on my journal, just from the date i notified them 🤷🏻‍♀️ then the month after when my next statement was generated they added the child element and everything like normal but wouldn't do it from the date of her actual claim for dla if that makes sense x

@Kirst31 id definitely question it or find out what’s going on. They can’t just not give you it and especially can’t over an overpayment of £369. It’s a lot of money you’ve missed out on and are entitled to x

Unfortunately it would seem not... you only have 13 months to ask for a mandatory reconsideration and that time frame is for extreme circumstances. although I would still have tried as you were lead to believe you were not entitled to it, so I would consider that extenuating circumstances. You can ask citizens advise to be sure but I think it's been left to long sadly.

I thought as much. Trouble is i was so new to it all at the time i didn't even think to take it any higher i just assumed i wasn't entitled to it and that was it x

I didn’t receive any texts messages or phone calls, I know some have become anxious about this. My daughter has been awarded HRC and LRM, I didn’t send any evidence and only put consultants contact information.

Good luck to everyone, the wait has been agonising x

Quick one if anyone can help me,
Do I need to inform tax credits once I have been awarded dla I already get it for my girl just been awarded with my lad, I am unsure as there will be no change to circumstance will they as before I no I got payment from tax credits for getting dla that won't happen this time? If anyone can help would be great thanks ladies x

Phoned again today, it’s with a decision maker and should have a decision anyday now, I thought my scan date was 18/8 but it is 16/8

I posted earlier on in the thread.

I’ve decided to do the change of circumstance, I was initially worried they’d take ds long award of hrc / lrm award if they tried their luck and this is what’s made me not want to attempt it, but don’t know why I’m sweating, my child would literally terrify the the devil himself, in fact I always say ds should have his own rate of dla 🤣🤣 I’m aware it’s a possibility they can downgrade but it’s nothing a MR / tribunal wouldn’t reverse if I’m realistic, so I’m now filling out his coc forms, for HRM.

Couple of quick questions, if anyone can help please.

Its the mobility I want looking at again, for HRM, but I haven’t filled the care side out for 5 years now (he got a 7 year award) so should I just do it all again? his needs are still ridiculously high but comparing him to 5 when awarded and 10 like he is now, are like night and day, his needs have obviously changed over 5 years, so am I best just doing the full booklet again? He couldn’t talk at 5 for example which I documented to dla on the forms back then, but now 5 years on, he verbally abuses anyone who passes his side, he’s completely verbal, so I can’t really say no change, he’s changed massively, but not so that his needs are less, they are more if that makes sense now he’s older. They could look at his whole award again anyway so I would rather they had up to date information to go by. What good is it if they read he’s non verbal from his last forms I filled out but then I’ve sent a piece of evidence for the coc saying he swears at members of the public and threatens to kill them etc.

As for evidence, i have collated a few bits and pieces, including a letter off camhs to show he’s a risk to other people and then I had a chat with his specialist headteacher this morning, she’s writing me a supporting letter, detailing a bad day at school and how he can’t be taken out in the community etc, and what immense support he requires in school to help him function etc, she said she will write she supports us in applying for high rate mobility,

another thing it asks me on the coc when did the worsening mobility start, and if longer than 4 months ago why didn’t I inform them sooner…. I don’t have a date, obviously, it’s just been a gradual thing over the years (and if I’m honest when he was awarded at 5 he should of got hrm and not lrm, but didn’t have the energy to appeal it all) so what do I put? Something a long the lines of, no specific date, ds needs have gradually worsened over the years and since he was already in receipt of dla and his needs haven’t improved they’ve only worsened (ie I don’t owe you any money so jog the fuck on 🤣) I didn’t think I needed to inform you. Would something like that suffice?

If we got the mobility car it would at least help me drive the 1300 miles a month I have to drive him to and from school since he’s been banned from transport. 🤔😩 why do they make everything so difficult.

Is the scan date the date they received the paperwork or the date I rang for the paperwork? Sorry I’m a bit confused

@danni0509 yes, complete the care part too. Especially because you don’t want your evidence contradicting your answers.

With your evidence, make sure you evidence all the points on the SMI &/or VUW flowcharts I linked to in a pp.

As well as writing DS’s mobility needs have gradually deteriorated you can include you are requesting a COC/informing them now after being prompted to do so following the removal of school transport due to DS’s additional needs. I wouldn’t mention you thought DS met the criteria for HRM at the time the previous decision but you didn’t appeal. You don’t want them to think you wouldn’t appeal again as they might think they have a better chance of fobbing you off.
