Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #67

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

A second Employment Tribunal, Sandie Peggie vs Royal College of Nursing, has just been heard. The hearing started on Wednesday 23 September 2026 and ended on Thursday 1 October 2026. It is possible that a decision will be handed down before Christmas of this year.

Additional legal claims have been raised. Sandie Peggie is taking action against three senior managers who were witnesses in the first Employment Tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

Having seen all this discussion of the FWS Supreme court judgement, I'm using my train commute today (and next week) to re-read it.

Currently on paragraph 9 which discusses how legislation is meant to be accessible to ordinary people:

"Citizens ... are intended to be able to understand parliamentary enactments, so that they can regulate their conduct accordingly."

I really hope that when eventually we get to an appeal of the original Fife judgement that Sandie and her totally normal expectation of a single sex changing room are written into the judgement like the "man on the Clapham omnibus".

I wonder what the work atmosphere is at the RCN today. I hope that whatever the outcome of the tribunal, it has an impact on their working practices.

I'm imagining a lot of shuffling about and not meeting anyone else's eye.

I don't feel sorry for them at all.

I’m not shocked at all. Neither am I surprised.

I was thinking about Naomi and the message she is giving which that there is an off ramp. It’s clever. It’s basically saying to the captured people at the captured unions and other organisations that they have a way out. Stonewall lied to them and misrepresented the law. Many other organisations and “trainers“ are still doing so. Not necessarily your fault - you took it in good faith.

Although it will be on you now, if you carry on.

Similar to when she 'put down a marker' in the other hearing? Only for a wider audience.

Is there training taking place for officers of the court / law regarding implementation of the SC's judgement? Is CPD in law centralised or is it just anybody who likes can have a go cf Denton's?

Apologies if this article has been posted already, I don’t think I’ve seen it. Is the bit about the timelines correct eg that in Feb 2024 the law allowed DU to use female SSS? I’m not clear on when the first two FWS cases were settled and would appreciate your collective wisdom!
He also said, in February 2024, when trans women had the right to use women-only facilities in Scotland, that the officer was therefore acting on the basis of a "contemporary understanding of the law" when he did not regard Upton's mere presence in the changing room as an issue.

As an aside, I don't think RCN's argument that they would have done better if only Sandie had told them she was GC flies. The support a union gives a member should not be dependent on the member knowing the correct magic incantation.

I think that's particularly pertinent to GC beliefs because most people who haven't had to engage much with this stuff will just think of it as the way things are. "Of course nobody can actually change sex! What are you on about?" They won't consciously frame it as a "belief", not because it's not deeply held, but precisely because it's so basic and ordinary.

It's like the bloke in the French play who discovered at a mature age that the way he had been speaking all his life was called "prose".

My recollection is that NC countered his argument with details of what applied at the time and referenced the fact that DU did not have a GRC.

In which case including the quoted section without NC’s rebuttal is pretty misleading reporting.

I may stand corrected if I’ve misunderstood, however

Sandie hadnt heard of the term "gender critical" at the time. She just knew that a man shouldnt be changing with women and was naïve enough to think if asked politely he'd do the decent thing and leave.

If you think I’m not being attentive to the facts, or that my arguments aren’t cogent, then by all means say so — by pointing to the relevant facts and making the stronger argument.

Where I draw the line is at value-laden claims about my personal motivations or character: that I’m “cynical”, that I “don’t care”, that I’m acting in bad faith, and so on. That has no place in a civilised discussion.

You may read my posts and think, “God, that woman is stupid, cynical, unreasonable, unpleasant, a bad actor,” etc. That’s human. I very often have similarly uncharitable reactions to posts on these threads. But I don’t say those things to the poster, because I’m well aware that is contrary to the purpose of mumsnet and more importantly it undermine the purpose of discussion and, contributes nothing to the substantive issues.

So criticise my reasoning as robustly as you like. Show me where I’ve got the facts wrong. Show me where the logic doesn’t follow. but leave the ad hominem commentary out if it please.

I hope they recognise the courage of Sandie, Jennifer and the Darlington Nurses. All fabulous women. And also utterly charming on the wonderful photos by Iain. We will see an exhibition one day or plates in a Nick Wallis book.

I don't know who it is, and I can't actually prove anything, and yes it may all be a coincidence, but sometimes the obvious answer is the correct one.

Then you’ll be happy to answer a few simple questions.

  1. What is your biological sex as defined at birth?
  2. Do you identify as trans?
  3. Do you identify as non-binary?
  4. Do you have a child/spouse/sibling who identifies as trans?
  5. Do you have a child/spouse/sibling who identifies as non-binary?
  6. Do you agree that biological women (as defined at birth) should be able to use toilets and changing intended for women without encountering biological men (as defined at birth) in those facilities?
  7. If you think that biological women should share facilities with men who identify as women, please explain why.
  8. If you think that men who identify as women should be allowed to share facilities with biological women, please explain why. I appreciate this is the same question framed differently, but I am interested in understanding why men who identify as women get to be in single sex spaces?
  9. If you believe that men who identify as women need special facilities and treatment for their own safety, privacy and dignity, why do you think they should be in women’s spaces rather than campaign for their own spaces?
  10. Finally, what is the problem with biological men using men’s facilities and biological women using women’s facilities and those who identify as trans who feel uncomfortable in the facilities of their biological sex, using the accessible facilities?
