Sandie Peggie: Employment Tribunal, associated legal claims, and related matters - thread #64

TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

That letter is splendid.

I particularly enjoyed the aside about planning permission - it seems some people are able to consider multiple aspects of an issue and that there may be more than 1 regulation involved.

The thing I would changed is calling facilities gender-neutral. It is nonsensical as there’s no such designs in regulations or legislation. People need to start calling them the proper terms which are unisex or universal. Sometimes people say mixed sex as the designs are not up to regulated standards so shouldn’t be called unisex or universal..

What does gender-neutral mean? A single sex toilet or changing room could be gender neutral and still be single sex.

We need to stop using gender-neutral.

My thanks to nauticant and the copy-pasters, and everyone else for the commentary.

I still have a very basic question in my mind about all these cases - who is the idiot person who does the 'reporting' and who is the even bigger idiot who makes the decision to accept the report as gospel? Rather than say 'don't be stupid, just go away and have a word with yourself '? Or even stop to think.

Especially in the case of JM, what with the paedophile's actual notes being written in the masculine and being in urology and all that. NW writes:

The story [of the overheard convo between JM and the Dr] is written into a letter which can be found in the Peggie v RCN trial bundle. This was sent to her by an unnamed RCN case officer who reported her account of the incident after a phone conference on 7 August 2024.

Who is this person? What was he thinking? And who took it seriously?

You've sunk to to depths of foolishness and desperation with that post Lacksie, as much as I disagree with you and your posts I thought you were better than to resort to that level of silliness.

Sex based rights as confirmed by the Supreme Court protect women who identify as men and as again pointed out in their judgement protect the rights of homosexuals. Quite why someone who purports to be decent would want to rip those rights away never fails to surprise me.
