Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton, following Employment Tribunal judgment - thread #58

nauticant · 11/12/2025 13:09

Judgment was handed down on 8 December 2025:
https://assets.publishing.service.gov.uk/media/6936ce28a6fc97b81e57436a/S_Peggie_v_Fife_Health_Board__Dr_Upton.pdf

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing was live tweeted by x.com/tribunaltweets and there's additional information here: tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-005 and tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr-bd6.

This made me properly hurhurhur.

Just reposting this. It's not a quick little fix because other bits build on the error. I think it is all going to unravel when people keep pulling at these threads.

Quoting from the last thread:

@weegielass · Today 14:22

If Big Sond had given the judgement to Naomi 5 days in advance, like she asked, she would have been able to tell him, and avoid this public ridicule (at least until the appeal)

Is this what happened? I thought that counsel got judgements early as a matter of course.

Anyway, isn't it fabulous that he made one more fuck up 😄

TT records show noth parties agreed on request for 5 days J said would need to ask President.

I bet Fife CEO & Comms team are crossing fingers that J makes even more edits to the decision than they made to their July press release.

its not being live streamed I've been told which is v disappointing

I am wondering how the Forstater misquote was brought to SK's attention, and why the other 2 haven't yet been. Maybe MF just rang up and told someone?

It was probably the journalist from The Courier's inquiry that tipped them off. Very strange that nobody has been following any of the rest of the discussion on social media, or they would have known that there was a whole load of other corrections to be made - some of which were probably actual clerical errors of lack of proofreading. They've still got the name of the Forstater case wrong. It's the Centre for Global Development, so CDG is obviously incorrect.

murasaki · 11/12/2025 15:03

This is what happens when you let the work experience kid loose on the judgement.

Suggests panic to me. Courier query sets them off in a blind panic about this. Can't find a quote to sub in for the life of them but under pressure from ET Prez as reputationally hugely bad so scurry to get this out then look up and see further incoming but too late.

Trouble is it was EJ Kemp himself. Humiliating. Let's not undermine that by suggesting it was someone lower down the ranks who, in all probability, would have been far more careful even if they had only been a work experience kid!

MyAmpleSheep · 11/12/2025 14:46

One of the contributors on Reddit whom I greatly respect <waves, again> says they have identified four other "phantom quotes" alongside the one that has now been removed from the judgment. (While declining to list them, to avoid 'helping' team GC).

So there may be more out there (or perhaps that poster's analysis isn't correct - it's easily done.)

I quoted him (and another one who seems to understand the legals) on the previous thread. Has he now put a number on it?

WeBuiltCisCityOnSexistRoles · 11/12/2025 15:06

Sad Times for Big Sond alright. Fuck all sympathy and I hope NC eviscerates(right word?) this in her usual efficient and crisp, take down manner!

@nauticant I am feeling a bit bad for you that this has gone way over what we all expected! If the thread (I want to say “curation” but that’s really wanky) starting is becoming an annoyance, please say. I am happy to step in. The only problem is I am a little unreliable (uncontrolled epilepsy bonkers atm so plans go awry a lot) but I’m sure we have lots of willing volunteers for back up etc. please do say if it’s becoming an intolerable pain in the arse. You have done heroically.

ProfDrILikeDungs · 11/12/2025 15:06

Perhaps now this board will learn the lesson and we will see fewer tedious "I asked ChatGPT for a legal analysis and it said this" posts!

It is called AI but there is no intelligence. None. Everything ChatGPT and similar generates is a hallucination, not just the errors. They are stochastically constrained hallucinators.

Using the word "Intelligence" is what Wittgenstein called "bewitchment by language" (triggering a meaning in your head that is already there). We all know what intelligence means. Call this artificial intelligence and your brain does the rest. Just like the re-naming of transexuals and tranvestites as "transwomen". That word is there, so our brain is supposed to think "oh, woman. Ok."

I've got a meeting at 3pm! Argh on video as well so I can't keep an eye on this thread to get the live reactions to the press interview. It is happening at 3pm isn't it?

This must be so stressful for poor Sandie and her family.

Are we 'invited'? I can't find any publicly available info about press conference apart from on here. Will it just appear if press start a live blog or similar?

ProfLargofesse · 11/12/2025 15:07

Yeah! Will be appealed.

ProfLargofesse · 11/12/2025 15:07

And Ben Cooper added to team! Yeah!

OhBuggerandArse · 11/12/2025 15:07

Mollyollydolly · 11/12/2025 15:07

Ben Cooper!!

Beerlzebub · 11/12/2025 15:08

They're appealing! And they've got Ben Cooper!!

murasaki · 11/12/2025 15:08

Yay, Ben is on board!
