NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

5 days advance notice was agreed for this one. Sandie's team has been on top of comms throughout so I'm.sure they will release and publicise it as soon as allowed.

In my ideal world... BezMills would also be included in the 5 days advance release to prepare his Big Sond (Law Laird o Dundee toon) summary of the judgment.

Be fair. La Bumba doesn’t know if she’s a woman so she can’t be expected to know if anybody else is.

Although that doesn’t sit entirely logically with her implied belief that people are what they say they are.

I think there was something quite magic about freeflowing it in real time. It was a bit hectic doing the TT C+P, and inventing the magical-realism events in the courtroom plus The Fifer's take, all at once, and I didn't get much work done those days cough cough.

It didn't allow too much time for self-editing, which was maybe a good thing - I am a massive overthinker and not having time to think too much probably helped the flow.

I don't know if I would be better if I had more time to sit and percolate, maybe I'd be worse!

That voice was pretty much what I took from the way you wrote it, @BezMills ! The only difference was I heard a slightly deeper voice.

She said those comments likely at their open board meeting on 25th Nov.

Oh and an actual judgement still to come.

But yes in your early 50s it’s the perfect time to choose to retire and it was entirely not connected to your utter raging sheer incompetence.

It isn't usually, but this time there was a brief discussion at the very end about this point. Naomi asked for 5 days and the judge agreed.
Edit: I don't think it follows, though, that we'd necessarily get 5 days, or perhaps any, notice. It might be that the parties would want to use the five days specifically to get their comms in order before people started hassling them, so telling us the 5 day clock had started might defeat the purpose!
